General Sales
Policy:
All sales final, AS-IS.
Product is NOT inspected before it leaves our warehouse, We are not responsible
for finish problems (fairing scratches, finish rubbing off, etc, AS IS
) We DO NOT exchange, replace or service products. Sold AS IS!!
We DO NOT replace small parts
such as missing, lost, broken, partially broken, stripped bolts, screws,
seals, gaskets, washers, reflectors, rubber caps, tire caps, spacers,
cotter pins and such. Please contact us ONLY when there is a serious damage
or defect.
ANY small issues will fall
under AS IS clause. It is up to us to decide which issue is small.
We reserve the right to ship
ANY color for ANY reason. We can guarantee 99% that you will get proper
color won.
Defective Parts/Engines
Policy:
ALLSTARSALEZ
is offering you ONE YEAR LIMITED warranty
on all parts plus 6 MONTHS WARRANTY on all ENGINES. Labor /time is NOT
covered.
Every replacement part will
be shipped FREE OF CHARGE during 12 month period. However small
handling fee will be required before shipment of any parts for ANY reason
at ANY time. Small handling fee can be anywhere between 5-30 USD or more
depending on how many parts we are shipping. We reserve the right to waive
handling fee at any time depending on circumstances.
Defective Engine Warranty:
Chances of having defective engine are very small, less then 0.1%. If
you are unlucky one with bad engine please contact us. We will replace
engine FREE OF CHARGE. Old engine can be sent back to us for FREE
(in Canada only, US buyers will have to pay for return shipping). Other
options will be offered as well depending on the situation. Bike itself
cannot be returned or exchanged.
Any labor cost involved in
fixing various things and your time is NOT covered by our warranty.
These are solid products with
very small defect rates. Chances that you will have a problem with anything
on your product are very small. We are here to work with you in the even
of any problem and we have parts to support just about ANY problem that
can come up.
UPS Related Issues:
UPS Lost my item: In
the event when UPS lost your item we will file for UPS TRACE which usually
takes 7-10 business days to end (or more) depending on circumstances.
As soon as trace is done and UPS CLAIM is issued we will reship product.
We cannot ship your item before claim is issued. For more information
how missing item policy works please contact UPS .
UPS damaged my item:
In the even of damages we will require small handling fee to ship any
plastic parts to replace damage. Just like defective item policy handling
fee is anywhere between 5-30 usd to package and ship replacement parts.
We reserve the right to waive handling fee at any time depending on circumstances.
UPS delivered my item late:
Shipping and handling is NOT refundable under any circumstances. Generally
UPS Standard delivery takes 1-2 business days in BC, 2-3 business days
in AB, 3-4 business days in SK, MB, 5 business days in ON, QUEBEC, NB,
NS, NF.
UPS damaged my item and
sent it back: We will reship product free of charge if UPS sends product
back to us by mistake. However DO NOT refuse ANY shipment regardless product
condition. We will work with you to resolve any damage related issues.
PO BOX shipments: Make
sure we have FULL street name/number address, as we do not ship to PO
BOX.
FOR ALL OTHER
UPS RELATED ISSUES PLEASE CALL UPS.
IMPORTANT:
THERE IS VERY LITTLE
OIL INSIDE THE ENGINE. IT WAS REMOVED FOR SHIPPING PURPOSES. YOU WILL
HAVE TO BUY 4 STROKE MOTORCYCLE OIL AND ADD PROPER AMOUNT TO THE ENGINE.
As per ebay policy you are
NOT allowed to bid if you are underage of 18. All suspicious bidders will
be reported to ebay.

By placing the bid, you are entering into a legally binding contract to
purchase the item and agree with all terms and conditions as outlined
in this auction page. We will pursue our available options given to us
per eBay's user agreement in the event payment is not received within
7 days, unless prior arrangements have been made.
We reserve the right to retract
bids from bidders with negative feedback or non-paying history without
prior notice. Bidders with minus feedback rating are not allowed to bid.
Waiver of Liability:
I, being above the age of 18 years of age or the parent
of a child under the age of 18 years of age, agree to all terms as follows:
I acknowledge and
understand that riding an ATV, Go Kart, Mini Chopper, Dirt Bike, Motocycle,
Pocket Bike and Gasoline Scooter (from now refered to as SCOOTER(s)) is
a dangerous activity that requires strenuous exercise and various degrees
of skill and experience for individual riders. I understand that these
activities can result in serious injury to the person and damages to property
and voluntarily assume any and all risk associated with loss, damage or
injury while riding these SCOOTERS.
I am aware of the
risks, hazards and dangers of personal injury, death and disability inherent
with the specific use of SCOOTERS as well as those inherent risks, hazards
and dangers of personal injury, death and disability. I am aware that
the usual risks, hazards and dangers of personal injury and disability
increase with inexperience.
I hereby agree to
release and forever discharge Parnus Global Trading Corporation or it's
Parent Company, and their agents, servants, employees, officers, directors,
trustees and all other persons or entities acting on their behalf and
the manufacturer from any and all claims, actions, damages, liability,
cost or expenses and attorney fees which are related to, arise out of,
or are in any way connected to my participation or use of the SCOOTERS,
use of equipment or property supplied by Parnus Global Trading Corporation
or it's parent company or my presence upon the premises, whether or not
such claims, actions, damages, liability, cost or expenses are caused
by the negligence of the seller, the manufacturer or the distributor.
By this AGREEMENT, it is my intention to surrender and waive any rights
to sue or exercise any legal right to seek damages from Parnus Global
Trading Corporation or it's Parent Company and their agents, servants,
employees, officers, directors, trustees and all other persons or entities
acting on their behalf.
This AGREEMENT shall
be affecting and binding upon my heirs, agents, personal representatives
and assigns.
I hereby certify that
I am over the age of 18 years of age. I have carefully read the foregoing
and acknowledge that I understand and AGREE to all of the above terms
and conditions. I have had the opportunity to ask any and all questions
regarding this AGREEMENT and the affect of the same. I am aware that by
purchasing this item and sending/remitting payment for it/them, I assume
all risk and waive and release certain substantial rights that I may have
or possess. I therefore release all liability and waive all rights I may
have in regards to my child's activities with the above item(s).
Legal Status of Products:
I
have read this waiver of liability, assumption of risk and indemnity agreement,
fully understand it's terms, understand that I am giving up substantial
rights by agreeing to this waiver and have brought it freely and voluntarily
without any inducement, assurance or gaurantee being made to me. My purchase
is to be considered as a complete and unconditional release of all liability
to the greatest extent allowed by law.
Additional Clause for Online Purchases:
All
sales are final, no refunds. By refusing a shipment, you agree to pay
the shipping cost as listed on this auction as well as a 50% restocking
fee, no exceptions. Seller is not responsible for any/all damages caused
by improper assembly and/or misuse of products purchased. If you have

For off-road use only,
12 years of age or older, always wear a helmet, never carry a passenger,
take time to learn and practice, don’t drink and ride, stay within your
limits, maintain your vehicle in safe condition, athletic ability, mental
and emotional maturity must be determined by the parents, wear protective
clothing, do not modify the ATV, do not operate on paved surfaces, do
not remove your hands or feet from the handlebars or footrests, do not
operate at excessive speeds, use extra care on unfamiliar terrain, use
extra care when in poor conditions, or rough, slippery, or loose terrain,
do not attempt wheelies, jumps, or stunts, turn at low speeds, learn safe
controlled skidding, avoid excessively steep hills, never operate the
ATV in fast-flowing water, maintain proper tire pressure.
