What types of Properties are there in the U. S.? There are Government, Federal, State, Local City or Towns,  Private Institution,  Private Property (most people are aware of), also Patented Property, etc.
  All Properties that I know of, have Regulation, Restrictions, Zoning, Ordinances, and or Covenants, etc..
 Looking at the last three types of properties, we see that:
 1. Private Property: pertains to Real Property, First, the surface of the property and certain things affixed to it by nature or man; Second, that which lies beneath the surface; and Third, the air space above the surface.
 2. Patented Property: is the Conveyance of title to government property.
 3. Un-patented Mining Claim Property (MCP), is Real Property: The 1872  law declared  all valuable mineral deposits in property belonging to the United States...to be free and open to exploration and purchase.

If you have lived in California for over 50 years, as I have, you would have seen that the coastal properties (Location) have in the last 10 to 15 years went from $100,000 to over one million dollars, why, Location and there is only so much of it to go around (supply and demand). Just like Private Property, MCP will go up in price.  Where and Why? Closer to larger Cities? Why, Location and  Supply and Demand,  people do not like to go far to see there Property (they do not like to spend a lot of time or money to get to it).
 
Most people you talk to, and if you asked them about, What is Patented Property,  or Un-patented Mining Claim Property, they will say they do not know. Once, more people learn about Un-patented Mining Claim Property (MCP) and what they can do with the property, the price will get closer or even higher in price, than the  Private Property. Why.
 
Some reasons are:
 1A On Private Property, if you want to sell off some of the acres, you have to hire a Legal Surveyor, which may cost you thousands of dollar. With Un-patented Mining Claim Property (MCP), you do not have to have a Legal or any Surveyor to split off 10 acres or more. All you have to do, is to amend, by hand drawn on a piece of paper, what you want to do and send it to BLM with $5.00
 1B. Both Private Property and MCP can be taken by the Government, thought Eminent Domain, etc. and where the Government has to pay you fair market value, or due compensation.
 1C. With Private Property, your property may be Assessed with different Waste,  Weed, etc. Abatements, Assessments, Delinquent Fees, Bonds, that you are not aware of; NOT with MCP.
 1D. With Private Property the owner is responsible for damages he did not make. And the owner of a MCP is not responsible for damages on a MCP he did not make.
 1E. It is true that Fee Title with MCP remains with the Federal Government until patent is issued (acutely that is a good thing, that way you have all of the listed and more protections).
 1F. It is true, that the right of the owner of a MCP, to place buildings and or cabins for residential purposes on the MCP must be directly related and incidental to the mining operation. IT IS ALSO TRUE that there are Many, Many, that have built cabins, residential building, commercial buildings, etc. on MCP with no mining operation, or mining.
 1G. Property, Property, Property; Remember, the MCP is not dependent on Gold or other Minerals. The price of Gold or other Minerals will go up and down like other commodities. There are many other valuable minerals that may be on the MCP. Even discovery of mineral is not required. Can be based wholly on inferential evidence; geological conditions; discoveries of minerals in adjacent properties or geological conditions; or other observable external conditions.
 2. With Private Property, if a person Trespass on the Private Property, the trespasser can legally  acquired rights in the Private Property (check with any good Real Estate book(s) to see) ,  with 
Un-patented Mining Claim Property (MCP) the trespasser can not legally  acquired rights in the MCP.  Even if a person mistakenly or not,  files a Location Notice on your MCP, they cannot acquire no rights thought Trespass. You can even file Felony Charges, in line with California Penal Code title 13, Sec. 487 d.
3.  With Private Property, if a person Trespass on the Private Property, the trespasser, if he gets hurt, the trespasser can bring legal action on the Private Property Owner (check with any good Real Estate book(s) to see). The Trespasser,  trespassing on the MCP and if the person gets hurt, has to bring legal action against the U. S. Government, First, the trespasser has to file and get permission in Federal Court, to bring action against the U. S. Government, then if that is granted, than the trespasser has to file in Federal Court, and bring legal action against the U. S. Government.
 
4. The Date that is put on the Location Notice (line 3),  is the date that the Legal Locator becomes the owner of the MCP, this is the Date of Ownership, not the date of filing, etc. The person that has the earlier Location Date is the owner. The person second is a trespasser and cannot acquire no rights thought Trespass.
 
4A. Do not purchase a MCP from a person that has not had a MCP for at least a year,  there may be a withdrawal etc. ( withdrawals may be put on properties for a limited period of time) on the property ( if you have a MCP before any withdrawal, than the withdrawal does not apply to you).
 
5. What is the cost of the MCP if you hold it, for 10 years, If you have 10 MCP or less, and file the Assessment Work Notice + Waiver of $5.00 to BLM and same document with $8.00 to the County Recorder for 10 years, with  Taxes of about $30.00 in that County; The 10 MCP will cost you about $450.00 for 10 years, all you have to do according to Federal Law is send in the papers each year ( all you have to do is legally, is change the date on the Assessment Work Notice Form that you filed the year before). What will be the MCP be worth in 10 years? What a great gift to give to someone.
 
6. Once more, when more people learn the truth about Un-patented Mining Claim Property and what you can do with it, the price will get closer or even higher than the price of Private Property.
 
7. Probably, one of the most important reasons to own a MCP, is, Just Knowing You Have a Place To Go, If You Want To, If You Have To!!!

Yes, It is True, That some say, That these Mineral Lands, MCP (mineral lands are a very, very, small part of the public land system) will be turned over to private lands. This will give the counties more money and save the U. S. Government money. This will mean the owners will be able to sell the MCP lands, for about 10 to 100 times or more. So that is a Good Thing when it happens.
 The Federal Government has many ways for you to obtaining good properties, I do not know them all. But one, I do know and like is the May 10, 1872 General Mining Law, which declared " all valuable mineral deposits in lands belonging to the United States....to be free and open to exploration and purchase". This 1872 General Mining Law, was declared right after the fifteenth Amendment of the Constitution of the United States, and right before the Sixteenth Amendment of the Constitution of the United States. The reason I say this, is in the past history, Congress has refused to change any of these old laws. In fact the 1872 General Mining Laws of today, have had very little change, from of old. Please do not Trespass on other MCP, The Laws are harsh.

Some have asked this questions, but they really don't understand what it means.

May I provide some information that might help you understand:


  1. In regard to “Public Land Mineral Rights”.  The ownership of the "“Public Land Mineral Rights" provides much protection under the Federal and State Laws.  

  2.  The United States Supreme Court in 1930, said in regard to Public Land Mineral Rights. The land or property is "a grant by the United States of the right of present exclusive possession." that "The claim is property in the fullest sense of that term;" you are the owner, and the property or land  "may be sold, transferred, mortgaged, and inherited."  "and is real property", "The owner is not required to purchase the claim or secure patent from the United States; but so long as he complies with the mining law, his possessory right, for all practical purposes of ownership, is as good as though secured by patent...."

  3.  In regard to  Public Land Mineral Rights, it is true that the government has what is called Fee Title in that Land or Property, and that is good, because it gives you protection.  Remember this is Public Land or Property and if you are the Public, and you are, your ownership of this land or property is guaranteed by the Constitution of the United States and the 1872 General Mining Laws, but also the laws set out in these books. Location and Patenting of Mining Claims and Mill Sites in California (about $15.00 from The U.S. Department of the Interior Bureau of Land Management). Or the United States Code Annotated Title 30; Mining Law from Location to Patent; also Mineral Title Examination; by Terry S. Maley; The American Law of Mining by The Rock Mountain Mineral Law Foundation (best), etc.. Federal Registrar, and more! Remember some of these lands, properties in the past have bought, sold for millions of dollars!       

  4.   It is true that on Mineral Land you can live all year long on it as long as you are mining on it.

  5.  It is true on Mineral Land you can build commercial buildings for the mining operation also residential buildings.

  6.  It is true on Mineral Land you can do anything you want as long as it is legal and related to mining.

  7.  It is true on Mineral Land you have protection by the Federal and State laws.

  8. It is true on Mineral Land you can patent part or all of the land or property, so it is private land, once current moratorium on patenting is lifted.

How to turn the Mining Claim Property into Private Land?
First off, it is a waiting game! Waiting for the Laws to change. And they will. The laws were before 1994, you could.

You have to wait for the current moratorium on patenting to be lifted, then pay the $2.50 or $5 an acre specified under the 1872 Mining Laws. This is for Mining Properties Owners Only.

Or wait for the Congress to enact laws, for those that have Ownership, or Own Mining Claim Property  to buying public land, or turn the land into Private Land!

There are other representative of Congress that have supported it, than what is stated here. You can find out more on this from the Federal Registrar found at most  large libraries, etc.

Tracy Republican Richard Pombo hopes to help --mining  controversial plan would ease buying of public land. WASHINGTON - Mining --buy up lots of California public land under a controversial bid by Tracy Republican Richard Pombo.  officials imposed a moratorium on mining patents in 1994.
Mariposa Republican George Radanovich supported it.  The provision would lift the current moratorium on patenting - that is, buying - public land under the 1872 Mining Law.

Instead of the $2.50 or $5 an acre specified under the 1872 law, the new provision  said Brian Kennedy, a spokesman for the House Resources Committee. "What this is about is continued economic development for rural communities in the West that are dependent on natural resources industries."

Kennedy added that refuges, parks and designated wilderness areas would be off-limits. But Sen. Dianne Feinstein, D-Calif., contended that the bill --"The Senate's version of the budget reconciliation bill ---the 44-year-old Pombo, who in recent months has drawn both high praise and sharp criticism for his broader environmental agenda. -- If you do not have any Mining Ownership as stated, then you will not be able to Patent or turn the land into Private Land!

Remember, you do not have to Patent or make all the land Private Land, you may only want the land along the Highway to be Private Land, then the cost would be Low and you would still have ownership of the rest of the Land, protected by the Federal Government.
Unless you are only going to sell the land, and that you can do at anytime, read at the website the advantages of:

 If you ever drove a car or flew a plane from the West coast to East coast and you can see the ground, it is all somebody's property. Some of the properties with vary little value, some next to large cities with much greater value (there is far less Un-patented Mining Claim Property (MCP) then Private Property), and you might have said to yourself, why did I not purchase some of that property 10 years ago??? Well, you always said, if I could only get at the ground floor, or at the start of something; Well here it is!!! The statistics, facts, etc. show that people like property, property that is close to larger cities; Because, all of past history shows that kind of property going up in price the most!!! There is only a limited supply of that kind of property, that is usable (has a road to, not far from home (or other peoples homes). Will you wait another 10 years and ask yourself that question? Why did I not purchase some of that property 10 years ago??? 
 
 Is there GOLD and other minerals on the MCP??? YES, YES, YES!!! If you look at the Gold Districts of California, Bulletin 193, it says Ruby Mt. gold-mining district is in southern San Bernardino County and northern Riverside County  Also look at Mines and Mineral Resources of San Bernardino County California, put out by the California Division of Mines and Geology, County Report Minerals of San Bernardino County. The Gold and other minerals have been washing down from the hills for eons of time. How many channels, faults, crevices, etc. can you find that traps gold or other minerals with Modern Technology??? Will you find them or someone else??? You can not, if you don't have a MCP!

What is a MCP? The United States Supreme Court in 1930 (case of Wilbur v. U.S. ex rel. Krushnic, 280 US 306 1930) said: when the location of a mining claim property is completed, it has the effect of a grant by the United States of the right of present exclusive possession. The claim is property in the fullest sense of that term; and may be sold, transferred, mortgaged, and inherited without infringing any right or title of the United States. The right of the owner is taxable by the state; and is "real property". The owner is not required to purchase the claim or secure patent (but may) from the United States; but so long as he complies with the mining law, his possessory right, for all practical purposes of ownership, is as good as though secured by patent.... So than, the United States owns (fee title), and the United States grants the right of present exclusive possession to the MCP owner, with all mineral rights to all valuable minerals. Because the United States owns (fee title), and the United States grants the right of present exclusive possession to the MCP owner, with all mineral rights to all valuable minerals; the Mining Claim owner do not have to do any-thing  to the property if they do not want to. It is the responsiblity of the United States Government to take care of any problems, like waste, weed, etc. Abatements, or having the creek cleaned, etc.. So if you want fee title, or ownership of the land that the U.S. has, you have to go though the patent procedure. Some say there is a moratorium on, others say there is not. There are good books on the procedure at most large Law Libraries.
 
YOUR OWNERSHIP IS FOREVER, on the Mining Claim Property(MCP), as long as you file your proper paper work  once a year, (you can file the proper papers from January though August of that year) San Bernardino County. You are not obligated to actually mine the MCP. The Federal Government says your  only requirement each year is to file the Assessment Work Notice (+ waiver), that says you are the owner and where the MCP is and what work you did. (The Federal Government says nothing about doing the work.)  Pay $5.00 per year (you should do about 5 hours of work each year on the MCP like clean the roads, etc.); Or file a Maintenance fee for $125. each year (you do not have to go on the MCP for that year) that says that you are the owner, and where the MCP is.
 
CAN YOU BUILD on the MCP? YES as long as it is "needed" for the Mining Operation. Cabins for residential purposes on the MCP must be directly related and incidental to the mining operation.  Did you know that on many Private Properties you can not build, because the properties do not comply to Zoning, or the properties are in a flood plan, or the properties will not perk, or the properties are two small, or the real question,  should be, why would some one want to build out in the middle of nowhere, etc. But people hold on to Private Properties and pay High Taxes, Why, because the past history shows that the properties have went up in value, especial those, close to large cities. Most people use a RV on the these MCP's, and any building, you would need the Building Department, Planning Departments OK, etc.. Check and see on any other property in the area, on a good road to, the cost. Try to find one under $100,000? You will see you can not. Most others (not this one) properties are land locked, with no roads to them (not this one), or you need a 4X4 on a bad road though someone ales property (not this one), that they will not give you permission to go though there land, NOT THESE MINING CLAIM PROPERTIES. We at this time have a lot of properties, and are letting some go at a very low price. Remember some MCP's in the past and recently have sold for millions of dollars, why, Location, Location, Location.
 
WHAT ELSE CAN YOU DO with these Mining Claim Properties? You can do anything legal and related to mining on the MCP. You can mine for Gold or others minerals. You can Camp, Fish, Hunt, Hike, Swim, Raft, Relax etc. on the MCP (please check local regulations, most require license for fishing, hunting, dredging, etc.). One can lease, sell, will, inherit their MCP. If you find a 70 pound gold nugget, it is yours, or any size, you, as an owner, of course, get to keep it all.
 
A-ABLE MINING will sign over a  Deed to you, and you will pay $295.00 for the paper work. We will prepare the papers and send it to you and to the BLM  to Transfer the Mining Claim Property Deed, over to your Name. Each County gives Numbers too; Assessor's Parcel Number (APN): There is no County Assessor's Parcel Number on these properties. These Properties are Administered by the United States Department of the Interior, Bureau of Land Management (BLM), that give Numbers to them. In California, it is California Mining Claim (CAMC) # number;
