Payment:  Payment arrangements must be made within 48 hours after auction ends.  Payment within 3-5 Business Days is required. Bank Check, Cashier’s check, and wire transfer are the methods of payment.  We do not accept PayPal or Credit Cards for heavy equipment purchases.  All funds must clear before machine leaves our warehouse. New York State Sales Tax applies to ALL local pickup and deliveries made within New York State.

Auction Policy:  Your bid is a contract to purchase.  Please do not bid if you cannot follow through with the terms and conditions of sale and pay for the item promptly.  As the winning bidder you enter into a legally binding contract to purchase this item.  We reserve the right to cancel any suspect bids from bidders with excessive negative or neutral feedback.  If you are new to Ebay we welcome you and ask that you please contact us to discuss any questions you may have prior to bidding.  We reserve the right to end any auction at any time if the item sells locally from our Syracuse New York warehouse store. 

Sales Tax:  New York State Sales Tax applied to ALL local pickups and deliveries made within New York State.  If you come from out of state to our Syracuse warehouse to pick up your equipment and take possession of it within New York State you are subject to 8% sales tax which must be paid.  If we ship your equipment and deliver it within New York State you are subject to Sales Tax regardless of where you live. If you are exempt from sales tax you MUST provide a copy of your sales tax exempt certificate at the time of purchase - not afterwards - to be exempt.  We accept forms for farm exempt, exempt organization, exempt for resale, and exempt use.  These must be properly filled out and signed by a company officer. We will only accept New York State Forms to be tax exempt.

 Shipping:  This item is being sold FOB Syracuse New York.  All shipping, including returns, is the sole responsibility of the buyer.  You can contact this company for a quote or contact the shipping company of your choice.  For a quote please e-mail your zip code, city and state.  All freight quoted is to a commercial delivery address.  We can ship to residential addresses but must be notified beforehand to get the proper rate.  All heavy equipment ships on dock-high flatbed or van style tractor trailers and you need the ability to unload.  If no dock or forklift is available for unloading, we recommend using a local towing service with their rollback truck to assist in safe, fast, unloading.  Small palletized items and equipment can ship via common carrier.  You are not obligated to use our freight quote/carrier and can certainly set up your own shipping with your local carrier.  If you choose to use our freight it will be added to our invoice and paid directly to us at time of payment for the equipment.  We have great shipping rates nationwide. If you choose to use our freight you are dealing directly with the carrier to schedule delivery and unloading.  We have no control over third party trucking schedules; delivery times, delays, etc. so please keep this in mind when using our discounted freight rates.

Non-Paying Bidders:  By bidding on this auction you are stating that you understand Ebay's policies and our payment options and policies.  Any Non-Paying bidder will be left negative feedback and appropriate actions will be taken through Ebay.

 Second Chance Offers:  Occasionally we have more than one of an item and do offer second chance offers.  This will come to you directly through Ebay and the Ebay message system.  Call to confirm authenticity.

 Inspection:  You are welcome to inspect any equipment we have for sale on Ebay prior to bidding on it.  Just contact us for directions.  Our auctions run for 7-10 days which gives you plenty of time to come see the equipment, check with the manufacturer, and obtain the information you need to bid.  All specs and information stated in our advertisements are to the best of our knowledge; some specs may be estimates, so we recommend that you contact the manufacturer to confirm all equipment specs.  Hours stated are the hours that are currently showing on the hour meter.  We cannot guarantee machine hours since it is secondhand equipment.  We are not responsible for errors and omissions.

 Pick-Up:  You are welcome to pick up your equipment during regular business hours and on weekends by appointment.  We will load your truck or trailer at no additional charge.  The buyer is responsible for securing your load properly for transport.  It is the buyer’s responsibility to come with the appropriate equipment to haul the equipment purchased

Storage:  All items purchased must be paid for within 3-5 business days of winning the auction.  We can hold equipment for a short term while freight and local pickup arrangements are made.  After 30 days from date of winning bid, storage fees will apply.  We have a high volume warehouse and may choose to store your equipment outside.  We will not be held responsible for any damage or mechanical issues related to storing your equipment.  After 60 days your equipment will be considered abandoned.  We will sell it to cover our expenses and storage fees and all funds will be retained to cover said fees. 

Returns:  All items sold are sold in as is, where is condition, as shown without warranty expressed or implied.  Equipment is used with average wear and described the best to our ability.  Once an item has shipped or been picked up it is non-returnable.  Please take advantage of our 7-10 day auctions to inspect the equipment, ask all questions, and check with the manufacturer prior to bidding.

By purchasing our equipment on Ebay you are dealing directly with CNY Rack and Surplus.  We are a New York State based used equipment company and all transactions take place in New York State, Onondaga County for legal purposes.  All purchases will be accompanied by company invoice and sales contract with liability paperwork to be signed by the buyer without exception.
