Exceptional manuscript document on vellum -- John Robins, mariner from Teignmouth (a town that grew from a fishing port associated with the Newfoundland cod industry), to Robert Holdsworth, merchant from Dartmouth, release of a plantation at Ferryland in Newfoundland, April 13, 1765, for L100.
Signed by Robins at bottom edge, with his red wax seal between "John" and "Robins." Named as owners of adjacent lands are Thomas Holdsworth, Richard Passmore, and John Keats Esq'r (one of His Majesty's justices of the peace at Ferryland). Also mentioned is "Ships room called Cold East."
"This Indenture Written on parchment Stampt according to the several Acts of parliament and made this Thirteenth day of April In the fifth year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland King Defender of the Faith and so forth and in the year of our Lord One thousand Seven hundred and Sixty five - Between John Robins of Teignmouth in the County of Devon Mariner (Only son and Heir at Law of his deceased father John Robins late of Dartmouth in the county aforesaid Mariner) of the one part and Robert Holdsworth of Dartmouth aforesaid Merchand of the other part Witnesseth that the said Robins party hereto for and in consideration of the Sum of One hundred pounds of Lawful money of Great Britain to him in hand paid by the said Robert Holdsworth at or before the sealing and delivery hereof The receipt whereof he the said John Robins party hereto doth hereby confess and acknowledge and thereof and therefrom and of and from every part and parcel thereof Doth acquit Release and discharge the said Robert Holdsworth his Heirs Executors and Administrators and every of them by these presents He the said John Robins party hereto Hath Granted Bargained Sold Aliened Released Engrossed and confirmed and by these presents Doth Grant Bargain Sell Alien & Release Engrosse and confirm unto the said Robert Holdsworth (In his Actual possession now being by Virtue of a Bargain and Slae to him thereof made for one whole year by Indenture bearing date the day next before the day of the date of these presents and Executed before the Execution hereof and by force of the Statute for transferring Uses into possession) and to his Heirs and Assigns All that plantation Situate lying and being at Ferryland in Newfoundland Bounded on the North part with a Ships room called Cold East, On the south part with a Ships room and the Lands of Thomas Holdsworth merchant dec'ed father of the said Robert Holdsworth and Richard Passmore Merchant deceased On the East with Ships room And on the West with the Lands or plantations of the late John Keats Esq'r One of his Majesty's Justices of the peace at Ferryland aforesaid of which said plantation the said John Robins the father was the first occupier or possessor and the same was confirmed to him by Charter from the then Governor of Newfoundland aforesaid but now the said plantation is in the possession of the said John Robins party hereto or his Tenant or Tenants Together with all Ways paths passages Waters Watercourses Easements proffits Commotities Advantages Hereditament and Appurtenances whatsoever to the said plantation belonging or in any wise appertaining or therewithal commonly used occupied or Enjoyed as part parcel or member thereof or of any part thereof And the Reversion and Reversions Remainder and Remainders Rents Duties and Services thereof and of every part thereof And all the Estate Right Title and Interest use Trust possession Term and Terms for years property Claim and demand whatsoever in Law and Equity of him the said John Robins party hereto of in and to the same and of in and to every part and parcel thereof with the appurtenances Together with all Deeds Writings Scripts and Illimments which touch or concern the said premises or any part thereof now in the Custody or power of the said John Robins party hereto or which he can or may Get or come by without Suit at Law or in Equity To have and to hold the said plantation and all and singular other the premises hereby Granted and Released or Intended so to be with their and every of their appurtenances unto the said Robert Holdsworth his Heirs and assignes To the only proper use and behoof of the said Robert Holdsworth his Heirs and assignes for ever To be Holden of the high and chief Lord and Lords of the Fee and Fees of the said premises by and under the Rents and Services therefore due and of right accustomed And the said John Robins party hereto for himself his Heirs Executors and administrators for every of them doth covenant Grant and agree to and with the said Robert Holdsworth his Heirs Executors and administrators and to and with every of them by these presents in manner and form following (That is to say) That he the said John Robins party hereto now is true and Lawful Owner of the said plantation and all and singular other premises hereby Granted and released or intended so to be and everypart and part thereof with their and every of their appurtenances and is Rightfully and Lawfully seized thereof and of every part and parcel thereof of a good dure absolute & Indefeizable Estate of Inheritance in fee simple without any manner of condition Trust Covenant provisoe or Limitation of use or uses or other Restraint matter or thing whatsoever to Alter, change Charge Determine Incumber Defeat or [ ] the same And also that he the said John Robins party hereto now hath good right Lawful and absolute power and authority in himself to Grant Bargain Sell Aliene Release Ingrosse and Confirm the said plantation and premises hereby granted or mentioned or Intended so to be as aforesaid and every part and parcel thereof with the appurtenances unto the said Robert Holdsworth his Heirs and Assigns in manner and form aforesaid And that he the said Robert Holdsworth his Heirs and Assigns and every of them shall or Lawfully may from time to time and at all and every time and times hereafter Have Hold Occupy Use Possess and enjoy all and singular the said plantation and premises hereby granted & released and every part and parcel thereof with their and every of their appurtenances and all and every of the Rents Issues proffits & Commoditys thereof coming arising or growing to have receive & take to his and their own proper use and behoof without any manner of Lett Suit Trouble Eviction Disturbance Hinderance or Molestation whatsoever of or by the said John Robins party hereto his Heirs Executors or Administrators or by or from or under the said John Robins his said deceased father or any other person or persons whomsoever Lawfully claiming or to claime the said plantation & premises or any part or parcel thereof by from or under him them or any or either of them And that the said plantation and premises hereby Granted & released or mentioned or intended so to be and every part and parcel thereof with all and Singular their & every of their appurtenances now are are & be and from hereforth forever hereafter shall Continue Remain and be unto the said Robert Holdsworth his heirs & assigns free clear & freely & clearly and absolutely freed and acquitted Exonerated & discharged of and from all and all manner of former and other Bargains Sales Gifts Grants [ ] Devises Uses Wills [ ] Dowers Intails Estates Leases Rights Titles Rents Arrears of Rent Debts Duties Judgements Executions Statutes & Merchand and of the staple and all Debts of Record Extents Charges Titles Troubles and Incumbrances whatsoever had made committed done acknowledged or suffered or caused to be had made committed done acknowledged or sufffered by the said John Robins dec'ed or the said John Robins party hereto or either of them or any other person or persons whomsoever lawfully claiming or to claime by from or under him them or any oe either of them And further that the said John Robins party hereto his heirs Executors & Adminstrators and all and every other person or persons whomsoever having or Lawfully claiming or which shall or may at any time hereafter have or lawfully claim'd any Estate Right Title or Interest of in or to the said premises hereby granted & released or meant or Indended so to be or of in or to any part or parcel thereof shall and will from time to time & at all times hereafter stand upon the reasonable request and at the cost and charges in the Law of the said Robert Holdsworth his Heirs or Assigns or some of them Make Do Levy Execute Acknowledge & Suffer Or cause to be made Done Acknowledged Levyed Executed and Suffered all and every such further & other lawful and reasonable Act and Acts Thing & Things Devise & Devises Assurance & Assurances Conveance & Conveyances in the Law whatsoever for the better and more perfect Assuring and Conveying the said plantation & premises hereby Granted & Released or intended so to be with the appurtenances unto the said Robert Holdsworth his Heirs and Assigns According to the true Intent and meaning of these presents Be it by Fine or Fines Recovery or Recoverys Release or Confirmation or by either of the said ways & means or by an other ways & means in the Law as by the said Robert Holdsworth his Heirs or assigns or any of them or by his or their Council Learned in the Law shall be reasonably Devised or Advised and required And so as the person or persons that shall be required to make or Execute the same be not compelled or compellable for the doing thereof to Travel from their respective habitation or Habitations In Witness whereof the parties aforesaid to these present Indentures their hands and Seals Interchangeably have put the day and year first above Written."
