THE EQUIPMENT THAT IS USED IS SOLD 'AS IS’, WITH ALL FAULTS ACCEPTED WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR AGAINST INFRINGEMENT. NEW EQUIPMENT IS WARRANTED ON A CASE-BY-CASE BASIS. IF THERE IS NO PRIOR AGREEMENT OR DETAILS INCLUDED IN THE DESCRIPTION, THERE IS NO WARRANTY.

LIMITATION OF LIABILITY

IN NO EVENT SHALL SELLER BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ADVANCED SUPPLY LIMITED'S PERFORMANCE OR FAILURE TO PERFORM UNDER THIS SALE, WHETHER DUE TO BREACH OF CONTRACT, NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE.

Hal's Wholesale makes no representation of any item sold to be fit for a particular purpose and assumes no liability for its use or misuse. It is assumed that the unit will be installed and operated by qualified personnel. The purchaser agrees that the seller shall not be held responsible or liable for any injuries or damages, whether incidental or consequential, associated in any way with the equipment. The Purchaser, by bidding on this equipment, indicates their acknowledgment of and agreement to the terms of this disclaimer.

GOVERNING LAW

The laws of the State of Alabama govern this Agreement. Parties agree that Alabama courts have jurisdiction over themselves and this Agreement, that Alabama is an appropriate place of venue for any litigation arising hereunder, and that all litigation related to this Agreement shall, to the extent possible, be in Alabama.

SHIPPING

Buyer is responsible for shipping and handling charges. Insurance is optional. Please notify us if we will be shipping to a business or a residence. There is an additional charge to ship freight to a residence. Shipping and handling continental US via UPS GROUND, FED EX GROUND, UPS FREIGHT, AAA COOPER FREIGHT or FED EX FREIGHT. Items will ship same day if order is processed before 2:00 PM CST. This shipping timeframe is only possible on items that we can make available immediately. Certain items may take longer depending on their Location within our Facility (email for details). We do offer item pickup. It is available by appointment only. We sell and ship to the United States only.

SALES TAX

Alabama sales tax is the responsibility of the Buyer and will be collected by Hal's Wholesale, when applicable, unless a Resale Certificate or Production Exemption Certificate is submitted to Hal's Wholesale.
