General Terms and Conditions:

Condition; Item Description	We have done our best to reveal the material condition of the offered piece in sufficient detail. Item listed is “as-is” unless other wise stated. We are not experts in this type of merchandise: accordingly, if any item is not “As described” in our auction page, your sole recourse is to ask for a refund under our “Return and Refund Policy,” described below. In no event will we be responsible for any defects in the conditions that are either disclosed in our items description or are clearly depicted in our auction photos. We disclaim any and all warranties, express or implied, regarding any items sold on eBay, including but not limited to warranties of merchantability and fitness for a particular purpose. The seller will not be held liable for any incidental or consequential damages related to the use or misuse of the item under any circumstances.
Photos	We are not professional photographers. Colors may appear slightly different to each bidder due to individual monitor settings on your computer. For that reason, colors may vary slightly between what you see on your screen and the product you receive. We are not responsible for slight variations in color, and will not accept returns based on this except in extraordinary circumstances where it can be clearly proven that the discrepancy was our fault.
Return and Refund Policy	If you feel an item has been incorrectly described on our auction page, please e-mail us within three (3) days after the auction closing and explain why you feel that way. If we agree, you will return the item to us in exactly the condition it was in when we delivered it to a “common carrier,” including all original tags. When we receive the item back from you, we will refund your winning bid amount, less sales tax, shipping & handling and delivery charges, promptly but in no event later than seven (7) days after we receive the item. If any item is returned to us in a condition different from the condition it was in when we delivered it to a “common carrier” or we believe in good faith that the item returned is not the same as the item we shipped to you, we will notify you and return the items to you without a refund. Except for the above return and refund policy, ALL SLAES ARE FINAL. Request for returns or refunds made after three (3) days following an auction closing date will be honored only in our sole discretion based on compelling evidence that we were at fault.

Shipping and Handling Charges	The winning bidder, if located in the United States, will pay a “shipping and handling" charge of $2.00 for priority, parcel post, fist mail, delivery confirmation, highly protective packaging, and loving handling. This fee is based on our actual costs of shipping and handling, and complies with all eBay polices regarding such fees. The winning bidder, if located outside of the United States, will pay the actual shipping charges we incur (duty taxes, customs charges, etc)  and a "shipping and handling charge of $10.00, which must be paid in full before we ship. If you have a preferred method of delivery, we will be happy to use it as long as you let us know within one (1) day after an auction closes and you agree to pay the fee charged by that carrier. Otherwise we will use the carrier we are most comfortable using based on our prior experience with similar items.
Shipping Schedule	We typically ship Monday thru Saturday. Shipment will go out within One (1) or Two (2) business days of receipt of cleared payment.
Insurance	We offer insurance as an option on all our auctions. If we do not offer insurance as an option on any auction, you may nonetheless ask us to insure delivery for an additional fee. We will determine the additional fee and notify you before shipping. We will not refund your money if items are lost, damaged, stolen, or destroyed in transit unless you buy insurance (see below).
Risk of Loss	We pack all items with greet care, and will assume risk of loss until we deliver the item to a “common carrier” (such as the U.S. Postal Service, UPS, FedEx, etc). In the unlikely event the item is lost, damaged or destroyed before we deliver it to a “common carrier” our only liability or obligation to you will be to refund promptly any monies we have received from you. In such event you agree not to post “negative” or “neutral” feedback for the transaction, and neither will we. We will provide proof of delivery to a “common Carrier” to you upon your request, along with tracking numbers in the “common carrier” has given them to us. At the moment we deliver the item to a “common carrier,” risk of loss in the item shifts from us to you. This means that you, from that moment forward, assume any risk of lost to the item from any cause or circumstance whatsoever, whether or not within your control. We strongly recommend that you purchase insurance for items over$50.00 or whatever amount represents an unacceptable loss to you, because if you opt not to insure, we will not be responsible for any loss, theft or damage to any items after delivering the items to a "Common Carrier" as described above.
Sales and Use Taxes	State and local sales tax will be added to your wining bid if you live in any of the following states: Illinois.  If you believe in good faith that you are exempt from sales tax, we will not waive sales tax unless you furnish to us a completed and signed” resale exemption certificate” in the form required by your state’s tax authority.
Overseas(non-U.S.) Buyers	Your purchase may be subject to value-added tax (VST), general sales tax (GST), customs duties, and other taxes, payment, and impositions required by the law of you county. Please consult with your accountant or tax adviser before bidding in any of our auctions. The laws of your county may prohibit you from buying or importing our items; be sure to check with your attorney before bidding on any item that may be illegal in your country. We are not a “commercial vendor” in any county other than the United Sates of America, and are accordingly not obligated to comply with any laws, license requirements, or regulations in your country unless we are advised otherwise by our legal counsel. All payments must be made in U.S. Dollars and we will not accept any other currency. The U.N. Convention on Contracts for the International Sales of Goods shall not apply to any of our auctions or sales on eBay.
Restricted bidder	We will not honor bids from eBay members with a feedback rating of less than ten (10) or a feedback rating that is less than 95% positive. We will reject bids form any person who was a “nonpaying buyer” (see below) in any of previous auctions. If you fall into any of these categories, please do not bid on any of our items.
Bid Retractions	Once you have placed a bid in one of our auctions, “your bid is a legal contract” and you may not retract it for any reason without our permission, which we may withhold in our sole discretion. Please DO NOT BID until you have all of the information you need about an item; if you have already bid on an item before requesting additional information, you will not be allowed to retract your bid based on the additional information we provide you.
Nonpaying Buyers	We do not tolerate nonpaying buyers (NPB’s). If you are the winning bidder and you fail to contact us within 3 days after an auction closes, or if you fail to tender all funds due to us within 7 days after an auction closes, we will presume you are a nonpaying buyer, your purchase will be canceled, you will receive “negative feedback” from us on eBay’s Feedback Forum, and you will be barred from ever bidding again on our auctions. If you are planning to go on vacation or business trip when the auction closes and will not be able to communicate with us within the above time periods, please contact us is advance and let us know so that we do not mistakenly treat you as a nonpaying buyer.
Auction Termination	We reserve the right to terminate any auction prior to the closing date for any reason. In that event we will notify each bidder, and let them know whether and when the item will be reposted. IF an auction ends at any time during any eBay outage (regardless of eBay policy or classification), the auction will be canceled and the item reposted at a later time. In that event we will use our best efforts to notify all bidders via e-mail of the new auction posting.
Communications to Seller	All communication to us should be sent to the following e-mail address:kmlynchassoc@att.net.  We will use our best efforts to respond to all e-mail communications within twenty-four (24) hours of receipt. Any additional information we provide you about a particular item may, at our discretion, be posted to our auction page or otherwise made public for the benefit of all bidders.
Disputes	In the event of any dispute involving one or our eBay auctions, you agree to submit the dispute to eBay’s SquareTrade mediation service before leaving “negative” or “neutral” feedback for us on eBay’s Feedback Forum or pursuing any other legal remedy. By bidding in any of our auctions, you irrevocably agree that any dispute, conflict, or controversy between you and kmlynchassociates will take place only in a court of law located in Cook county, State of Illinois, United States of America, and will be governed by the laws of the State of Illinois that apply to contract between resident of that state.
	Unless we state otherwise on a particular eBay auction page, all of kmlynchassociates eBay auctions are subject to the above general terms and conditions.
