Shipping and Payment

We reserve the right to use what is in our opinion an equivalent service provided by a carrier other than UPS™, USPS™ or other party listed in the shipping calculator. We require the buyer to take shipping insurance on heavy, fragile and other items that we feel are particularly susceptible to damage in transit. We do not, regardless of any party's opinion as to the cause, guarantee that loss or damage claims will be paid by the carrier or underwriter. It is recommended that you DO NOT SEND PAYMENT FROM OUTSIDE THE US BY PAYPAL ECHECK - IT COULD TAKE 2 WEEKS OR LONGER TO CLEAR! On Canadian destined shipments from Canada, GST/HST and, within Ontario, PST apply. The buyer must contact us no later than two business days after the close of this listing. For Non-DOA warranty only: The goods or services offered herein are sold as is, with all faults and without warranty of any kind, except covering "dead on arrival" ("DOA"), where relevant, unless otherwise stated. Not DOA shall be taken to mean the same as operational, which is to say that the goods or services will function at minimum to the degree described in the tests and observations of functionality as outlined. Not covered by this warranty are features, functions, capabilities, qualities, and the like, that are (1) not specifically described as having been confirmed as present, tested and functioning correctly, or (2) not specifically described otherwise as functioning correctly. Any noted deficiencies are based upon superficial inspection only and are offered without any guarantee of accuracy or thoroughness. The seller does not guarantee the presence or completeness of any components, features, capabilities, and the like, that might appear to be or are described as included or installed, as indicated by exterior appearances, labelling or other visual indications, but that are not confirmable without some disassembly or opening of the exterior case or enclosure or other verification procedure. The buyer acknowledges that the seller, in good faith, has relied upon this exterior appearance, labelling or other visual indications to describe what is offered. As well, given the diversity of items offered by the seller, the buyer acknowledges that the seller cannot possibly in all cases know how to inspect or evaluate the goods or services so as to determine flaws, deficiencies, damage and the like that might be apparent to someone more expert. The buyer therefore accepts that inaccuracies may arise as a result of these circumstances and, as related thereto, waives all rights to any refunds, partial refunds, compensation and damages of all types. In addition to what is included, basic or normally included items such as, but not limited to, software, power supplies, cables, components, accessories, as well as the appropriate expertise, may be required to test or use the goods or services, and the buyer should not assume that anything is included that is not explicitly stated as included. Batteries, lamps, bulbs, ink, toner, printer drums, other consumables, parts requiring sharpening and the like, and any software, whether installed on drives, in upgradeable read only memory or by way of any other storage medium, carry absolutely no warranty of any duration or kind, and any deficiencies related thereto may need to be corrected in order to determine operational status. Any damage incurred in transit, for any reason whatsoever and even as a result of real or alleged negligence on the part of the seller or others, is not covered by any guarantee or warranty. A determination as to whether such damage has been incurred shall be made solely by the seller using information gathered as to the condition of the packaging and contents upon arrival or return as well as other available evidence, and the opinion or decision of no other party, agency or body shall be relevant. The seller shall, at its option, replace or repair the item or refund the purchase amount, excluding shipping, insurance and handling charges, in the event that the item is not functioning (DOA) upon receipt and notification is given by email within the earlier of (1) five days of receipt of the merchandise or (2) twenty-one days of the commitment to purchase as indicated by either the close of the auction listing or the use of the immediate purchase option by the buyer. The buyer must advise of any other problems or concerns within the same time period. The serial number on the item or any component shipped may differ from that displayed in any photos used herein. The buyer is entirely responsible for determining suitability and compatibility, for obtaining all legally required licensing related to the ownership and use, any required firmware modifications, password and security resets and clearing, calibration, compliance with all taxes, brokerage fees, transfer fees, entry fees and the like and the payment for all or any of the above.

Such change in condition is not covered by any warranty or guarantee, and the buyer agrees not to interpret such change as misrepresentation of any sort. 4. Merchandise returned for any reason must be shipped prepaid and with a returned merchandise authorization number (RMA) obtained beforehand from the seller.
5. The eBay member listing these goods or services, the seller, its employees, representatives, officers, directors and agents shall not be liable under any circumstances for any total damages greater than the cost of refunding the purchaser's bid or buy-it-now amount.
6. In the event that the purchaser has requested and paid for shipping insurance, it is understood that no refund will be made until the seller has received payment from the carrier or underwriter of the coverage. It is also agreed that denial of an insurance claim, for any reason whatsoever, including the negligence of any party, will result in non-payment to the purchaser of the claim, and there shall be no further recourse. If the claim is paid by the carrier or underwriter, whether fully or partially, the amount paid under that claim shall be considered the full and final settlement amount covering all losses and damages sustained by the purchaser, and the seller is thereby released of any and all liability.
7. Any shipment entering a foreign country will be subject to the laws, regulation, duties and taxes and the like of that country as well as the prevailing conditions in that country, and it is understood that the buyer is responsible for paying all charges resulting as a consequence thereof. Further, it is understood that the seller cannot possibly be aware of such and similar conditions, and it is the buyer's responsibility to cover all cost related thereto. This cost includes, but is not limited to, seizure, mishandling, redirection or return of all or part the shipment. Shipments to other than the United States and Canada with a selling price of less than US$150 are not returnable under any circumstances. The selling price is defined as the bid or Buy-it-Now price, exclusive of any shipping, handling, taxes, duties or other charges not included therein.
8. It is understood that all reasonable efforts are made to describe accurately items offered for sale. However, errors and omissions do occur, and the buyer agrees under no circumstances to interpret such as a deliberate attempt to mislead or misrepresent. It is also understood that descriptions of capabilities, features, specifications and the like are gathered, in good faith, from the Internet and elsewhere and are supplied without any guarantee of accuracy or completeness. For accurate and complete information the buyer should contact the manufacturer, distributor or other source.
9. The buyer also recognizes that merchandise may be of such a nature, design or be in such condition as to present a threat to person and property, and hereby agrees to use, store and otherwise control it so as not to permit injury or damage to any person or property and to indemnify and save harmless the seller, its employees, representatives, officers, directors or agents against the consequences of such possibilities.
10. Any court action resulting from this transaction or in any way whatsoever related to it shall be dealt with in accordance with and subject to the laws of Canada and the Province of Ontario and be adjudicated in the Province of Ontario.
11. In placing a bid or using the immediate purchase option, the buyer thereby acknowledges full understanding and acceptance of all terms and conditions stated herein.

The buyer should assume that nothing whatsoever will be shipped, other than what is explicitly described as included herein. This includes, but is not limited to, power supplies, cords. cables, batteries, instructions as well as all other related and unrelated items that may be considered essential, desirable or otherwise to the use, operation, verification or testing of the merchandise offered.
