From Birmingham take I-65 south to Montgomery. When you get to Montgomery, take exit 167 Hwy 80 West – Selma. Go approximately 10.1 miles down Hwy 80. Make a right onto County Rd. 37. There will be a Bancorp South Bank directly across from the turn off of Hwy 80. Follow County Rd. 37 for approximately 3.7 miles. County Rd. 37 will end at this point. Turn left onto County Rd. 54. Follow County Rd. 54 for approximately 1.3 miles. Then make right onto Tawassee Pointe Dr., this is a dirt road. Follow this road for approximately 1.4 miles, at this point the road will split. Veer to the left along side the power lines.
You will see the first lot 34 about 50 yards on the right. Lot 35 is next to it a little further down the road. I have marked the Lots with FOR SALE BY OWNER signs. The property lines are denoted by Iron Poles in the ground at the front and back of each Lot. I have spray painted the poles bright orange and cleared out the area around each so they can be seen from the road. I have marked the trees along the property line with bright orange so you can walk the property lines from front to back.

RESTRICTIVE COVENANTS
These Covenants are to run with the land and shall be binding on all parties and persons claiming them for a period of 25 years from the date of the recording of this plat, after which time said Covenants shall be automatically extended for successive periods of 10 years, unless an instrument signed by majority of the then Owners of the lots has been recorded agreeing to change said Covenants in whole or in part. Enforcement shall be by proceedings at law or in equity against the person or persons violating or attempting to violate any Covenants, either to restrain or to recover damages. Invalidation of any one of these Covenants by judgment, or court order shall in no way effect any of the other provisions which shall remain in full force and effect.
1. LAND USAGE DAY AND DWELLING TYPE all lots In the subdivision shall be known and described as residential and shall be used for residential purposes only. No structure shall be erected, altered, placed or permitted to remain on any lot other than one detached single family unit for private use, not to exceed 2 1/2 stories In height, except that building comply with the prescribed use may be allowed, provided, however, that said building shall be of a nature commensurate with that of the main structure. No double-wide trailers, trailers, module homes will be allowed. Said single-family dwelling may be erected on any two adjoining lots. Those structures of a temporary character (trailer, basement, tent, shack, garage, barn or any other building) shall be used on any lot at any time as a residence, either temporarily or permanently.
2. DWELLING SIZE The ground floor of the main structure shall not be less than 1000 square feet of heated living area for a one story dwelling, and shall not be less than 1000 square feet of heated living area on the ground floor of a one and one-half (1 ½), two (2) or two and one-half (2 ½) story dwelling, exclusive of open porches and garages.
3. All construction, once begun, must be completed within 12 months.
4. SUBDIVISION no light shall be re-subdivided into smaller lots, nor conveyed, or encumbered in any less than one full original dimension of the original plot of record, except that re-subdivision is allowed provided no new additional member of tracks are created on plot.
5. EASEMENTS there is hereby provided a storm water spillage right-of-way upstream. No owner against any downstream lot owner of flow of storm water shall not artificially withhold or project in a concentrated manner. It is the intent of this requirement for natural drainage to sacrifice flow across the land in as its manner as practical, until it reaches road right-of-way of natural waters.
6. BUILDING LOCATION the building shall be located nearer to any right-of-way feet of nearer than 50 feet to any side of lines. For the purpose of this covenant, excess and shape shall not be a part of the building, provided, however, that they shall not be construed to permit any portion of a building on a lot upon another lot.
7. SIGNS no billboard or other advertising devices shall be erected or permitted on any tract of any lot, nor shall anything be done as permitted on any lot which will be faith or main the natural effect thereof. Exceptions of this shall only be at the entrance of the subdivision of which Is subdivision identification sign may be placed by the developers in a manner which blends a duty setting. This does not prohibit street side, or other identification sign such as mailboxes or “for sale” signs.
8. OIL AND MINING OPERATION all oil or gas drilling or mining operations of any kind shall be permitted upon any tract.
9. NUISANCE off-track shall be limited to residential use only, and no noxious or offensive trade or activity shall be conducted on any tract, or shall anything be done thereupon which may be or may become an annoyance or nuisance to the neighborhood.
10. OPEN FIRES that shall be no burning of trash, rubbish, grass, brush, etc. all such burning must be done in a safe, enclosed area with a mask cover to prevent burning particles from escaping.
11. SEWAGE DISPOSAL at the public sewer becomes available, sewage from any lot shall be disposed of by a property drainage outside disposal system by a licensed and registered professional.
12. TANKS no erected tank of any kind to be permitted upon any lot.
13. SATELLITE DISKS AND ANTENNA all satellite disks and antenna must be located at five a front and rear yards and no closer than 30 feet to any lot line. Entity usage shall not protrude higher than 10 feet above the highest roofline of the residence.
14. PROPERTY MAINTENANCE all owners shall keep their property in a neat appearance and shall not at anytime produce a nuisance, hazard or unsightly condition.
15. ARCHITECTURAL CONTROL all buildings shall be erected or placed on any lot alley until the construction phase and specifications and the plan showing the parameters of the structure have been approved by architectural control committee as to the quality of materials, harmony of architectural design with finished grade elevations, fencing (no closer to the street dandy minimum setback lines, unless similarly approved). The initial members of the architectural control committee shall be KR Cohen, Scott Catten, and James R. Colin. In the event of a death or resignation fitting member of the committee, the remaining members shall have full authority to delegate a representative at successor. Into the members of the committee or their designated representatives to be entitled to any compensation for the services performed pursuant to this Company. The committee’s approval or disapproval shall be in writing.
16. GARBAGE AND REFUGE DISPOSAL no tank should be used or maintained as a dumping garage for rubbish. Repose, garbage, or any way shall not be kept, except in a lawful container.
