By bidding on and/or agreeing to purchase this vehicle, the bidder/buyer agrees to be bound by the following terms and conditions:

Bidders acknowledge and agree that the negotiation, bidding and purchase of this vehicle takes place in the city of San Diego, County of San Diego, California.  Accordingly, the purchase and the purchase contract, regardless of conflicts of law and venue, shall be governed by and construed according to California law.  Bidders consent to the personal jurisdiction of the courts of California.  Any action or proceeding relating to or arising out of this transaction or the subject vehicle shall be filed, if a State action, in the Superior Court of the State of California for the County of San Diego, North County Division or if a federal action, in the 9^th  Circuit, California Southern District. 

Vehicle is sold “as-is”, “where-is”.  The Seller makes no warranties, express or implied, regarding the vehicle, and there will be no implied warranties of merchantability or of fitness for a particular purpose.

Vehicle is considered accepted by Buyer when removed from Seller’s location.

The history and condition of this vehicle is true to the best of Seller’s knowledge after reasonable investigation.  However, Seller is not the original owner and has owned the vehicle for a relatively short time.  It is up to you to verify the history, mileage and authenticity of this vehicle to your satisfaction prior to bidding.  Accordingly, the vehicle is available for inspection Monday through Friday at the vehicle location.  Inspections by you or by professional appraisers/mechanics are welcome.  Recommendations for professional restoration companies who can evaluate the vehicle for you are available at your request. 

You must be 18 years of age or older and a resident of the continental United States to bid.

By bidding on and/or agreeing to purchase this vehicle, the bidder/buyer agrees to be bound by the following terms and conditions:

Plus government fees and taxes, any finance charges, any dealer document preparation charge, and any emission testing charge.  Seller reserves the right to end auction early in the event the vehicle sells locally.  All financing offers are based on approved credit.

Winning bidder MUST communicate with us by e-mail or phone within 24 hours of the end of the auction to make arrangements to complete the transaction. If Seller cannot confirm your intention to buy or the sale is not completed within 5 business days, Seller reserves the right to re-list this vehicle or sell to any other bidder. Before the vehicle is released for shipment to the Buyer, all sale-related and title-related paperwork must be accurately completed, signed and returned to Seller.

Due to demo test drives and mechanical inspections, the mileage of the vehicle represented might be slightly different than the mileage stated when the vehicle was first listed on eBay.

Vehicle is offered for sale by a licensed California vehicle retailer.  Winning bidder must sign a California Retail Installment Sales Contract and accompanying paperwork prior to delivery of vehicle.

Warranty

This vehicle may have all or a balance of the manufacturer’s warranty.  See listing for details.  Otherwise:  Vehicle is sold “as-is”.  The Seller makes no warranties, express or implied, on the vehicle, and there will be no implied warranties of merchantability or of fitness for a particular purpose.  This provision does not affect any warranties covering the vehicle that the vehicle manufacturer may provide.

Shipping & Delivery

 Seller may assist Buyer with finding a commercial carrier offering discounted shipping at Buyer’s request with the following understanding:  Vehicle is sold “where-is” FOB at Seller’s location.  All shipping arrangements are made as a courtesy to Buyer.  Seller is not affiliated with any carrier. Any claims or other communication regarding shipment of vehicles will be between Buyer and the carrier and not with the Seller. The amount of time it takes for delivery depends upon the Carrier" selected. Buyer is responsible for any and all shipping, transportation and insurance costs.  Vehicle is deemed delivered when buyer, buyer’s agent or transportation company removes vehicle from Seller’s location.  Seller is not responsible for any liability, loss or damage incurred during shipping or transportation.

Return Policy

 If you are unsatisfied with the Vehicle you have just purchased, for any reason, Seller will refund 100% of the purchase price according to the following terms and conditions:

• You must cause the vehicle to be returned to Seller’s location on or before 5:00 p.m. of the tenth (10^nd) calendar day following the date of delivery to your location.  You must notify the Seller (via the e-mail address on file with eBay)  of your intent to exercise your refund right no later than 5:00p.m of the 7^th calender day following the date of delivery to your location.
• Shipping costs are non-refundable.  Buyer will remain responsible for shipping costs to deliver the vehicle to Buyer’s location and to return the vehicle to Seller’s location.
• The vehicle may not have been driven more than 150 miles (the difference between the mileage appearing on the purchase or lease contract and the reading on the odometer at time of return) between the date of purchase and the time you return it to the Seller.
• You must return the Vehicle in similar condition (physical and mechanical) as of the date the vehicle was delivered to your location.  Scratches, dings, dents, and interior blemishes caused while the Vehicle is in your control, will preclude a refund or offset the refund amount.
• The refund may only be exercised by each buyer one time.
• You agree to cooperate with the Seller and execute any paperwork necessary to return the Vehicle and complete the refund.

Sales Tax

Buyer is responsible not only for knowing their own states' laws regarding taxes and fees, but also remitting the proper taxes, fees, and documents for their state. All taxes and fees must be paid in full in order for the vehicle to be titled and registered.

Deposits:

Deposits are NON-Refundable unless the vehicle has been misrepresented or does not pass a onsite vehicle inspection. Deposits retained for non purchased vehicles are applied towards vehicle relisting fees, loss of productivity at dealership. As well as paperwork and titling documents.
