By bidding on / purchasing an item, you are noting your acceptance of the following terms and conditions:
Product Information
- The products sold in the K and N Auctions store have been classified as new, unless otherwise noted in the listing.
- All products are sold "as-is, with all faults," without any express or implied warranties, unless otherwise stated in the ad or listing, or except in those states and jurisdictions, which prohibit or restrict "as-is" sales of such products, in which case those buyers shall have only those warranty rights prescribed by the laws of their respective states or jurisdictions.
- All sales are FINAL. No refunds, returns or exchanges are allowed or permitted, except as specifically set forth below. Products may vary slightly from the pictures.

- Within 2 hours of the end of the auction, or confirming a Buy-It-Now purchase, you will receive an e-mail from us containing a link to our secure checkout site.

Sales Tax
- K and N Auctions will apply sales tax during checkout for all sales in all states based upon the delivery address.
- K and N has presence in all 50 states, and therefore has a NEXUS in all 50 states. States in which we have NEXUS require us to collect sales tax based on the individual state's statute.
- Please note that, while resellers are welcome to purchase from our site, we cannot process reseller tax id certificates. If so desired, please contact us via our Web Form to receive K and N's tax id - needed for reimbursement from your respective state.
- State and local taxes will be calculated based on the shipping address entered at time of checkout. Note that taxes are based on order total, including shipping charges, where applicable.
Shipping, Handling and Insurance
- We only ship to the United States (50 states and D.C. ONLY - No US territories). We cannot deliver to PO Boxes, APO, or FPO.
- At time of checkout the appropriate shipping charges (if any) will then be added to your order. Shipping is free for all items over $10. Buyers are responsible for all shipping and handling charges.
- We use United Parcel Service (UPS) Ground service for shipments to the continental United States, and UPS Air to Alaska and Hawaii. Orders will leave our warehouse in 1-5 business days.
- All shipments are insured for loss or damage, and the insurance cost is included in the shipping and handling charge.
- Upon shipment, you will receive a Shipping Confirmation email, which will include your UPS Shipment Tracking Number. You can use this number to track the status of your package online.
Return Policy
- All sales through K and N Auctions on eBay are final. No refunds, returns or exchanges are accepted.
- In the unlikely event that you receive the incorrect product, or your product is damaged in shipping, please contact customer service and arrange for an exchange.
LIMITED WARRANTY
Most items include an original manufacturer's written limited warranty. K AND N AUCTIONS DOES NOT OFFER OR PROVIDE ANY WARRANTY ON ANY PRODUCTS IT SELLS. If a product has a manufacturer's written warranty, then that fact shall be noted or stated in the ad or listing. In the absence of such a notation, the product has no warranty and is sold "as-is, with all faults," without any express or implied warranties, except in those states and jurisdictions, which prohibit or restrict "as-is" sales of such products, in which case those buyers shall have only those warranty rights prescribed by the laws of their respective states or jurisdictions. Where a manufacturer's warranty applies, the period and conditions may vary for each product. The terms and conditions of any applicable manufacturer's warranty are set forth in the product ad or listing, or are accessible for examination and review by a prospective buyer through a link displayed in the product ad or listing. Your dated sales receipt, showing the date of purchase, is your proof of the purchase date and should be retained by you for any claim you make under an applicable warranty.
If the item you purchased is found to be materially defective, the seller will, at seller's option, (1) repair the item, (2) replace the item with another item of reasonably equivalent type and grade, or (3) accept return of the item and remit to the purchaser a refund of the price paid, including the shipping and handling charge assessed and paid at time of sale and any sales tax collected from purchaser.
THE SELLER ASSUMES NO LIABILITY WHATSOEVER FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY ARISE FROM THE USE OF THE ITEM.
Liability Limit
IN NO EVENT SHALL K AND N AUCTIONS OR ITS PARENT, SUBSIDIARIES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PRODUCTS, BIDS PLACED ON EBAY, EBAY'S SERVICES OR THESE TERMS AND CONDITIONS (HOWEVER ARISING, INCLUDING NEGLIGENCE), INCLUDING LOST PROFITS, WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES WAS, OR COULD HAVE BEEN, KNOWN. THE LIABILITY OF K AND N AUCTIONS AND ITS PARENT, SUBSIDIARIES, AFFILIATES, AND SUPPLIERS, AND THE RESPECTIVE EMPLOYEES, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT PAID BY YOU FOR THE PRODUCT PURCHASED HEREUNDER, AND (B) $100.
Feedback
K and N Auctions will submit feedback on buyers upon successful checkout completion. In cases where buyers fail to pay for their items, K and N Auctions will initiate eBay's "Non-Paying Bidder" process.
