THE AUCTION

• You must be 18 years of age or older to Bid
• When you place a Bid, you are entering into a legal and binding contract to purchase this Vehicle described above, subject to the terms of sale provided below and eBay's rules. If you do not intend to purchase this item, please do not Bid!
• Please have all questions answered before Bidding. If you are not sure about something, please ask. Do not assume anything not listed is included.
• Your Bid warrants that you currently have funds to purchase this Vehicle. Therefore, Bidders must be able to pay for the Vehicle by cash payment or cashier's check in U.S. funds or otherwise be PRE-APPROVED for a sufficient loan before Bidding on this Vehicle. If you place a Bid and you cannot produce funds or obtain credit in the amount of the Bid we may have to file a non-paying Bidder report to eBay.
• The winning Bidder/Buyer will pay Seller a $199.00 Document Fee to cover Seller's incidental administrative costs and services.
• Seller reserves the right, at Seller's sole discretion, to cancel any and all Bids, and/or end the Auction early, before the scheduled closing time of the Auction. Seller will not be liable to Bidders for any such cancellation and/or closure.
• Bid retractions during the last 24 hours of our auctions constitute grounds for immediate auction cancellation and possible re-listing at the cost of the Bidder retracting that Bid.

AFTER THE AUCTION ENDS

• We will contact the Winning Bidder by e-mail within 24hrs after the auction closes.
• Winning Bidder must confirm its intention to buy by responding to our e-mail by Reply E-mail within 24-hours. Winning Bidder's Reply E-mail must include the Buyer's full name, address, phone number, fax number and specify a preferred mode of communication.
• If the Winning Bidder does not respond to our initial e-mail within 48-hours, Seller reserves the right to rescind the sale, re-list the Vehicle on eBay and/or offer to the Vehicle to the next highest Bidder, with no liability whatsoever to the Winning Bidder.
• DEPOSIT: Winning Bidder must tender to Seller an initial, non-refundable, Deposit in the amount of $500.00, within 48 hours after the close of the Auction. Acceptable methods of Deposit payment include cashier's checks, major credit cards, money orders, Pay-pal or wire transfers only. Upon tender of the initial Deposit, Buyer MUST fax a copy of its valid Driver's License, to authenticate Buyer's identity.
• FINAL PAYMENT: Full payment of the purchase price and all other applicable fees and charges must be made within 7 calendar days from the end of the Auction. Acceptable methods of purchase price payment include cashier's checks, money orders, or wire transfers only. Credit cards are acceptable for the DEPOSIT amount only. Checks and money orders must made payable to: Jumbo Auto and Truck Plaza. Instructions for bank wire transfers will be given upon request.

ABOUT THE VEHICLE

• We welcome and recommend pre-end-of-auction inspections by competent inspection services.
• All Vehicles are available to be test-driven and inspected by appointment. Buyer agrees to pay for all inspection fees and charges incurred by Seller or Buyer. If you choose to have the Vehicle shipped without inspection we will NOT be responsible for any breakdown, defect or failure of any type, whatsoever.
• Please understand that you are Bidding on a pre-owned Vehicle that has previously been driven and subjected to cosmetic and mechanical wear and tear. If you are expecting a pre-owned Vehicle to be absolutely perfect, please do not Bid. There is no such thing as a perfect pre-owned Vehicle.
• In accordance with the laws of the State of Florida, this Vehicle is being sold to you "AS-IS" "WHERE IS" with no warranty, expressed written or implied. The Seller shall not be responsible for the correct description, authenticity, genuineness, or defects herein, and makes no warranty in connection therewith. No allowance or set aside will be made on account of any incorrectness, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have thoroughly inspected the Vehicle, and to have satisfied him or herself as to the condition and value and to Bid based upon that judgment solely. The Seller will make every reasonable effort to disclose any known defects associated with this Vehicle at the Buyer's request prior to the close of sale. Seller assumes no responsibility for any repairs regardless of any oral statements about the Vehicle.
• In some cases, national Extended Warranties or Service Plans are available from a third party, or the original manufacturer's warranty may still be valid. Please call us to find out if you qualify.

TAX & TITLE INFORMATION

TAX: Payment of applicable sales tax and other taxes is the sole responsibility of Buyer.

• Florida Buyers: Seller is required to collect Florida sales tax from Florida Buyers before delivery of the Vehicle. Seller may issue a 30-day temporary tag to Buyer, where appropriate. Seller will send the Vehicle's Registration and/or Title to the Buyer by courier.
• Non-Florida Buyers: Non-Florida Buyers are responsible for all state, county, city taxes and fees, as well as title service fees in the State that the Vehicle will be registered and should make arrangements to pay such taxes and fees on their own. In most cases, all taxes and fees must be paid in full in order for Vehicle to be titled and registered. Where appropriate, Seller may issue a 30-day Florida temporary tag to Non-Florida Buyers, so the Vehicle can be driven to Buyer's home State.

TITLE:

• Each Vehicle we sell has a clean and marketable title, unless otherwise stated.
• Titles will be sent via certified mail or courier for proper tracking. In some cases, Seller will hold titles until such time that Seller can verify full payment of the purchase price and proper document processing. Thank you for your patience and understanding.

VEHICLE DELIVERY, SHIPPING & OTHER TERMS

DELIVERY:

• We welcome Buyers to pick-up their Vehicle at our Florida location, Monday through Friday, between 10am-5pm and Saturdays by appointment only. Buyers are encouraged to arrange flight arrivals at Fort Lauderdale/Hollywood International Airport (FLL) during these times. However, we do offer complimentary shuttle service to and from our dealership and Fort Lauderdale/Hollywood International Airport and Miami International Airport (MIA).
• Please also note that due to our high sales volume, we usually need an additional 48 hours after auction closing before a Vehicle can be picked-up or delivered. Final detail and document processing takes time!

SHIPPING:

• We can assist you with making shipping arrangements, but in any and all cases, the Buyer bears the risk of loss during shipping. All Vehicles are sold F.O.B. Jumbo Auto and Truck Plaza, Hollywood, Florida.
• All shipping charges and insurance are Buyer's responsibility.
• Licensed Carriers are usually insured. Seller assumes no responsibility for damages incurred after the Vehicle leaves Seller's premises. Any shipping arrangements are provided by Seller as a courtesy. We are not affiliated with any Carrier or Shipper. Any claims or other communication regarding damage of Vehicles will be between Buyer and the Carrier/Shipper, not with Seller.
• The amount of time it takes for shipping depends on the Carrier/Shipper, but note that delivery to destination within the continental U.S usually takes 7-14 days. We recommend that Buyers verify the Estimated Time of Arrival with their Carrier/Shipper to be sure.

OTHER TERMS: Venue for any claim or controversy that may arise in connection with the Auction, the Vehicle, or this sale shall be in Broward County, Florida and subject to Florida law. Any party that makes any claim hereunder hereby waives the right to a jury trial. The terms above constitute the entire agreement between Seller and Buyer and any oral representations are not binding.
