Colorado Springs Utilities/City of Colorado Springs Property Disposal Office Terms and Conditions for Sales of Surplus Property                  

 Bidder Agreement:

BIDDER ACKNOWLEDGES AND AGREES THAT ITEM IS SOLD TO THEM AS IS, WHERE IS WITH ALL FAULTS. THE CITY OF COLORADO SPRINGS/UTILITIES HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO. NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, DESIGN, CONDITION, CAPACITY, PERFORMANCE OR ANY OTHER ASPECT OF SAID ITEM.

Inspection:

• General condition and other available information regarding this item have been disclosed above. All items are described to the best of our ability, however many items come to us unknown. Any additional information would need to be obtained through bidder’s personal inspection of the item.
• Bidders are strongly encouraged to inspect the property prior to submitting a bid.
• Inspections can be made by appointment only by contacting the Property Disposal Office by telephone 719-668-7628.

Payment:

• Full payment is due within 7 calendar days after the auction's close.
• Acceptable forms of payment are cashiers checks made payable to the City of Colorado Springs, PayPal, and cash at time of pick-up
• Payments can be accepted in-person or by regular mail. Mailed payments must be postmarked within the above mentioned time period.
• Payment address is 2329 Steel Drive Colorado Springs, CO 80907.
• All sales are final.  
• Failure to make payment or failure to remove the property, within the terms allowed, is considered breach of contract.  In such an event, the Buyer shall lose all right, title, and interest which he/she might otherwise have acquired in and to such property as to which a default has occurred. 

Loading and Removal of Property

• All purchases must be removed from the auction site within 10 days of the end of the auction.
• Removal of property will be allowed only after full payment has been received by Seller. 
• Unless otherwise stated no service of any kind will be furnished by the City of Colorado Springs, and the successful bidder shall assume any cost of weighing, packaging, crating, loading or hauling, unless otherwise indicated.
• Loading hours are 7:30 AM to 3:30 PM, Monday-Friday, by appointment only. Please call 719-668-7628 for all appointments. These hours exclude Colorado Springs Utilities observed holidays. Unless otherwise stated, buyer will make all arrangements and perform all work necessary to effect removal of the property.
• Under certain circumstances, deemed appropriate by Seller, Seller will make the initial placement of the property on conveyance(s) furnished by the Buyer. Securing the load is strictly the responsibility of the buyer and/or transport operator.
