Buyer waives any and all liability of LBD, LBDOLLAR and claims against LBD, LBDOLLAR for damages, losses, costs, injuries, penalties, expenses, all attorney’s fees and liabilities of whatever nature whether in tort, contract, warranty or strict liability, including without limitation those resulting from injuries or deaths of persons and damages to property resulting from or arising out of or in connection with the use, condition, operation, loss or liability resulting from negligence, breach of warranty, parts, labor, possession, rental or sale of property, delay or business interruption by Buyer or third parties, delivery delays, work stoppages, service, transportation, failure to warn, operational deficiencies or failures, service, rental or sale of the property, breakdowns, strikes, acts of God, unavailability of the property or other causes (whether such causes are avoidable or not) caused in whole or in part, directly or indirectly by Buyer, LBD, LBDOLLAR employees, representatives, agents or third parties (collectively, “specified claims”). Under no circumstances is LBD, LBDOLLAR responsible for special, indirect, incidental or consequential damages, even if Buyer has been advised of their possible existence. Buyer agrees to indemnify, defend and hold LBD, LBDOLLAR harmless from and against any and all specified claims. There are no returns, exchanges, or refunds. LBD, LBDOLLAR reserves the right to determine the method of conducting the sale. Credit cards transactions that are rejected will result in a $48.00 fees assessed against the buyer, and may result in other sanctions by LBD, LBDOLLAR, up to exclusion of offenders from participating in LBD, LBDOLLAR sales or/and auction event/s. Credit cards submitted by a Buyer must be in the name of the registered Buyer and valid at the time a lot(s) is awarded. LBD, LBDOLLAR is not responsible for the errors of the Buyer in conveying the Buyer’s correct contact information. LBD, LBDOLLAR does not guarantee that its system for placing, receiving, collecting and tabulating bids on Internet auction sales will be available without interruption, error-free or free from other defects. LBD, LBDOLLAR assumes no obligation to ensure that a prospective Buyer’s bid is received, properly and effectively processed, or accepted. The proper venue for litigation against LBD, LBDOLLAR shall be in a state court in Denver, or Adams County, State of Colorado. The Buyer must pay the total purchase price before property may be removed from LBD, LBDOLLAR's site, location, etc. LBD, LBDOLLAR or/and Ebay will email you a final invoice. All Items must be paid after final invoicing within 3 days. In the event the Buyer fails to pay the entire purchase price within the time set forth by LBD, LBDOLLAR and/or fails to comply with any of the Terms and Conditions of the sale, LBD, LBDOLLAR will resell the property at public or private sale without further notice. Accordingly, in the event the successful bidder for any item fails, for any reason, to complete the purchase, LBD, LBDOLLAR reserves the right to accept the next highest bid. It is a violation of law to make bids in a false name, even if LBD, LBDOLLAR's software initially accepts such a bid. If property is not removed within the specified removal period, or scheduled for removal at a later date with the LBD, LBDOLLAR, the LBD, LBDOLLAR will consider the property to be abandoned by the Buyer and the Buyer shall have abandoned all right, and interest therein. Abandonment or late removal letters will not be sent by LBD, LBDOLLAR to the Buyer prior to exercising the right of abandonment. In the event that LBD, LBDOLLAR extends the removal period to accommodate a buyer's needs, the Buyer understands and accepts that the liability and risk of loss shall not rest with Luxury Bottom Dollar Corp., but shall be at the Buyer's own risk. PROSPECTIVE BUYERS ARE CAUTIONED THAT: The Buyer hereby agrees to defend, indemnify and hold LBD, LBDOLLAR harmless from and against any and all damages, costs, claims or liability (including reasonable attorneys' fees) for any injuries to persons or property of any type whatsoever, occurring during or resulting from the sale, removal, use or operations of the purchased property. If products/items are returned in a condition less than new, damaged, used, or not in their original box, including all parts, absent hardware, scratched, nicked, dented, any signs of installation, etc., - we may issue no refund or a partial refund and subject to a re-packaging and restocking fee at our unaccompanied decision. Many of our products are offered (was, is, will be) with free shipping, meaning shipping has been included in the price to provide you with the total cost of the order. If you return your purchase you will be responsible for the cost of shipping and handling it back (we will provide an appropriate return address via Email to you). You will be refunded the purchase price less our actual outbound shipping and handling cost and any applicable restocking fees when your return has been processed at the warehouse. Any items that qualify for free shipping and are refused by the recipient will have the shipping charged to the recipients account. This includes the cost of the outgoing shipping and return shipping. No Exceptions! Return processing time generally takes three to four business days. There will be a minimum twenty eight percent (28%) restocking fee on all returns! Shipping and handling fees are non-refundable and you must pay shipping to return the product/item back to us. For your protection when returning an item, please use a method that is insured and can be tracked. If the product is damaged, or lost during shipment, we are not responsible. It is the recipient's responsibility, when returning an item, to ensure it is packaged properly, so that it will arrive in good condition. Any damages from shipping item/s back to us will be the recipient's (your) responsibility and you will not be issued a refund. Shipping charges are not refundable. No Exceptions! We will return rejected item/s to you, only after you agree to pay the associated shipping fee. If you did not request return of rejected item/s within thirty (30) days after we notify you of the rejection, the rejected item/s becomes our property. If you have already paid for an item and it has not yet been shipped we can offer you a full refund minus a minimum fourteen percent fee if you decide you do not want the item. If your item has already shipped, you must refuse the package and it will be sent back to us. In this case there will be a minimum twenty eight percent re-stocking fee and you the customer are responsible for all shipping and handling costs. Any purchases made cannot be returned to a local store/showroom. We do not accept any returns made through any other store or retailer. All returns made to us must be accompanied by a Return Item Authorization number (RIA#), to receive proper credit. If a product is returned without an RIA number the return may be refused and or a restocking fee will be applied. Any items returned after seven days will be refused. No Exceptions! In the improbable occasion you receive a product that is inaccurate, missing parts, or damaged, defective from the manufacture. we will send replacements to you. Please email us so we can work with you and find a solution. Please do not send the item back to us without informing us of the situation first via email. A Customer service representative will email you back with all needed information and a Return Item Authorization number (RIA#). All defective or non-defective items must be claimed by the customer within seven days of receipt. No Exceptions! Special order, liquidation and as-is item/s are non-refundable! Any Stone, Tile, Lighting or Bath products may only be returned by freight, regardless of the weight of the product/s. If you choose not to send the above products via freight, and it arrives in damaged, you will NOT be issued a refund! Fireplace/s and any/all fireplace accessories are liquidation item/s, and available in anticipation that supplies exist and are non-refundable. In order to initiate a return or if you have any questions please email us and a customer service representative will assist you. We are making every attempt to use the best shipping and freight companies and best packing materials possible. Please note that freight and shipping companies require a signature at the time of delivery, for those reasons all orders must include your contact phone number/s! There are times when products may get damaged during shipping. We are not responsible for damages that occur during shipping. That is why it is the buyer's responsibility to check all products received before signing for them. If there is any visible damage to the product (other than what is described in our original description for that posting/s) it needs to be disputed with the freight and/or shipping company and then please email our customer service department. We will also try to contact the shipping/freight company from our side as service to you. If the box is in good condition but the product itself is defective please refer to the return process above. Any errors made on our part will be corrected as quickly as possible and as explained above. We are hoping that your order arrives in safety and that you are satisfied with your purchase. But once again, please remember that when the order arrives it is your responsibility to ensure that the product has not been damaged during shipping. Please follow the guiding principle below for inspection of your package/s: Please take the time to inspect the box for external damage, remove the packaging and inspect the contents for any physical damage in the presence of the delivery driver. If there is any damage, visible or not, you must indicate such on the delivery receipt. If you sign the delivery ticket and fail to note any damages, the merchandise becomes your property, shipping insurance will void and the freight/shipping company will not allow a claim. No refund/s, return/s, or/and replacement/s will be available, or possible! Please write clearly and be as specific as possible when noting the delivery receipt for any damages, rips, dents, scratches, compressed corner/s and side/s, shortages and etc. It is also a good practice to note on the delivery receipt if the lift gate was used, or lowered all the way to the bottom, if a pallet jack, or dolly was used, if product/s, item/s were covered, shrink wrapped, strapped to the pallet and/or to the side of the truck. If the damage is severe enough to render the product inoperable or unusable, please refuse the shipment and email us immediately. These simple and very imperative guidelines will give more surety that if shortage/s, or damage/s occurred the strict shipping and freight insurance regulations are easier to satisfy, and we will be able to refund, or replace your item/s with no additional charges (read complete return and refund policy for all conditions). Please make sure to read all terms and conditions as it may relate to you. Warranty: All items are suitable for their intended application unless otherwise declared in the description. There is no warranty at all on as-is, or liquidation item/s. We do not provide a warranty above what is stated here but if your item malfunctions within a short time of receipt we will do our best to reach a reasonable accommodation. If item malfunctions due to misuse, abuse, or if it was not installed by a certified professional/to the standard of the applicable industry’s best practices, then we cannot provide a warranty in this instance. We reserve the right to ask for any proof or information for our own, or joint investigation/s and/or needs in order to resolve any issues that may arise. |
