one of a two volume set. The author is something of an advocate for the idea of
jury trials. In his “preface to the Practisers of the Law” he states: “To say
this Trial by Jury is too popular in aMonarchy, would be a good objection from a Frenchman, but not of any
Englishman, who lives under the best tempered Monarchy, and the best Sort of
Government in the World, to which this Manner of Trial is so proper and
accommodated, that neither the Wisdom of our Ancestors could, nor (I may say)
can this present, nor After-Ages invent a better.”This volume contains much on what sort of trials shall come
before juries, the number of jurors, exemptions from juries, qualifications of
jurors, and “from whence the Jury shall come.”Much on challenges and precedents, and “of what things a
Jury may inquire.”Great stuff on
“the Demeanor of the Jury while they consider their Verdict.”There is a section on “Punishments
attending the misbehaviour of the Jury,” and other on “The Learning of General
Verdicts and of Arresting Judgements…..”
