Scarce, antique leather bound London-published 1766 law book on jury trials -- TRAILS PER PAIS: or, THE LAW OF ENGLAND CONCERNING JURIES BY NISI PRIUS, &c., WITH A COMPLEAT TREATISE OF THE LAW OF EVIDENCE, COLLECTED FROM ALL THE BOOKS OF REPORTS; TOGETHER WITH PRECEDENTS, AND FORMS OF CHALLENGES, DEMURRERS UPON EVIDENCE, BILLS OF EXCEPTION, PLEAS PUIS LE ARREIN CONTINUANCE, &c..  It’s volume one of a two volume set. The author is something of an advocate for the idea of jury trials. In his “preface to the Practisers of the Law” he states: “To say this Trial by Jury is too popular in a  Monarchy, would be a good objection from a Frenchman, but not of any Englishman, who lives under the best tempered Monarchy, and the best Sort of Government in the World, to which this Manner of Trial is so proper and accommodated, that neither the Wisdom of our Ancestors could, nor (I may say) can this present, nor After-Ages invent a better.”  This volume contains much on what sort of trials shall come before juries, the number of jurors, exemptions from juries, qualifications of jurors, and “from whence the Jury shall come.”  Much on challenges and precedents, and “of what things a Jury may inquire.”  Great stuff on “the Demeanor of the Jury while they consider their Verdict.”  There is a section on “Punishments attending the misbehaviour of the Jury,” and other on “The Learning of General Verdicts and of Arresting Judgements…..”

Woodfall and W. Strahan, for T. Waller, 1766. 5 x 8 inches.  344 pages.  Full leather binding.  Exterior spine joints were weak. I repaired them with strips of dyed Japanese art paper.  Color match not exact, but hinges are now solid.  The whole process is reversible, as I used wheat paste glue. No label on spine.  Owner’s antique bookplate on front pastedown. Japanese art paper front inner hinge repair. Light foxing within.  Otherwise, Interior is clean and bright.  Tight binding. Condition:  good…..
