YG Commemorative’s EBAY Terms and Conditions are only applicable for orders placed on Ebay and are independent from YG Commemorative’s normal Terms and Conditions found on YG Commemorative’s website.  Variations in Terms and Conditions are due to less direct interactivity between customer and YG Commemorative’s interactive website and an expedited manufacturing and delivery timeline for this customized product.  By purchasing YG Commemorative’s product on Ebay, you fully agree to the below terms and conditions.

AGE REQUIREMENTS

You must be at least 18 years old to order any YG Commemorative ® Product.     

DIGITAL PHOTOGRAPHS

YG Commemorative ® can only accept digital photographs via email for this Ebay auction.  By delivering the digital photograph ("Photograph") to YG Commemorative you warrant and covenant that (i) you own or otherwise possess all necessary rights with respect to the Photograph, (ii) the Photograph you have submitted does not and will not violate any intellectual property or proprietary right of any third party, (iii) you hereby consent to YG Commemorative's use of the Photograph in connection with the products ordered and (iv) authorize YG Commemorative to crop and size Photograph provided to best fit into product purchased.

• Digital photographs must be in .jpg format and be 4MB or smaller in size
• You are advised to take a straight on, eye-leveled headshot picture from the front using any normal digital camera with a megapixel rating of 3 MP (megapixels) or higher.  For best results, YG Commemorative ® recommends taking the headshot picture 2 – 4 feet away from the Graduate with a solid colored background without using any zoom-in functions found on a digital camera.  Additionally when taking the digital photograph, leaving approximately 12 inches of blank background space above the graduate’s head would be ideal when cropping the image.

COLOR ACCURACY OF DIGITAL PHOTOGRAPHS

While YG Commemorative ® makes every effort to reproduce every Photograph as accurately as possible, you acknowledge that due to variations in printing, different camera software, different monitor resolution and/or monitor settings, and other factors, the final product may not exactly match the image shown on your computer screen.  YG Commemorative does not offer any type of photograph touch up service.  The pictures provided will be the pictures used.

SPELLING OF CUSTOMIZED TEXT / SIZE OF TEXT / ALIGNMENT OF TEXT / COLOR OF TEXT

After full payment is made, customer is responsible for emailing to YG Commemorative:

• The exact (Case sensitive) customized text spelling that is to be found inside the banner portion.  There is a maximum of 25 characters allowed.
• The exact (Case sensitive) customized spelling of the Graduate's name.  There is a maximum of 35 characters allowed.
• Optional:  Indicate desired, common and readily available, color choice for graduate’s name text. 

Customer gives full consent for YG Commemorative to use best discretion to best size all customized text, best center align all the customized text, and choose an appropriate font size for the customer’s YG Commemorative product.  If no font color is indicated, YG Commemorative will use the default yellow font color found on examples.

PAYMENTS & REFUNDS

Due to the custom nature of YG Commemorative’s ® Products, all orders are absolutely non-refundable.  The full amount of the purchase price is due when orders are placed.  All information that is provided to YG Commemorative and/or our third party payment processor must be accurate, current and complete. 

DELIVERY DATE OF PRODUCT / METHOD OF DELIVERY / SHIPPING TO THE U.S. ONLY

All YG Commemorative ® Products are custom made.  For orders placed through Ebay, upon receiving: full payment, customer’s personalized text that will go inside of the banner, customer’s personalized text (typically a graduate’s name), and optional font color choice, YG Commemorative will rush manufacture the ordered customized product within 10 business days.  Upon manufacturing completion, YG Commemorative will ship product using ground delivery service.

Products are currently only available for shipping to the 50 states in the United States to any physical address.  Shipping/handling charges to any 50 states in the United States is $6.95 per medallion product.  Add $2.00 for each additional medallion.  Insurance is included in this charge.

LIMITED WARRANTY

YG Commemorative ® warrants the YG Commemorative ® Glass Mountain keepsake and YG Commemorative ® personalized medallion keepsake against defects in material and workmanship for a period of 14 days from the date of delivery ("Warranty Period"). YG Commemorative ®, at its option, will repair or replace this product or any component of the product found to be defective with a new or remanufactured product or component provided that you obtain return authorization prior to the expiration of the Warranty Period and return the product to YG Commemorative, postage prepaid and through "acceptable shippers" within 5 business days of receipt of such authorization.  This warranty does not cover damage due to acts of nature, accident, misuse, abuse, negligence, improper maintenance, or use in violation of instructions furnished by YG Commemorative ®.  In addition, please note, for the YG Commemorative ® Glass Mountain keepsake, each Glass Mountain keepsake is custom made to order and will vary due to the uniqueness of each piece.  Small bubbles found between the base and glass mountain body are not considered defects and are normal.

To obtain return authorization within the Warranty Period, you must first contact YG Commemorative ® to receive a return authorization.  Please send emails to: customerservice@ygcommemorative.com

INDEMNIFICATION

You agree to indemnify, defend and hold YG Commemorative and its officers, managers, members, employees, agents and suppliers harmless against all claims liabilities, losses, expenses, damages and costs, including reasonable attorney's fees, resulting from (i) any violation of these Terms and Conditions and (ii) any claim that a Photograph infringes a third party's intellectual property rights.

PRIVACY POLICY

YG Commemorative ® respects your privacy.  When an order is placed, you provide information including: your name, Graduate’s name, contact telephone number, contact email address, mailing address, and Graduate’s picture.  YG Commemorative ® will not sell, barter, lease, rent, donate, share, or make public your information.  YG Commemorative ® will only use information provided to fulfill your order.  In order to allow us to fulfill your order, we will disclose some or all of the information you have provided to among others, credit card authorization companies, our suppliers and shippers.  In addition, YG Commemorative ® may disclose your personal information in the following situations as we believe to be appropriate:  (a) under applicable law; (b) to comply with legal process; (c) to respond to governmental requests, including requests from law enforcement and regulatory authorities; (d) to enforce our Terms and Conditions (e) to permit us to pursue available remedies or limit the damages that we may sustain.    YG Commemorative ® seeks to have reasonable security measures in place to help protect against loss, misuse and alteration of the information under our control.  Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.  As a result, although we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or that is stored by us.  You acknowledge and agree that any information you transmit to us is transmitted at your own risk.    We reserve the right to modify our Privacy Policy at any time.   Any changes to our Privacy Policy will become effective upon our posting of the revised Privacy Policy. 

APPLICABLE LAW

The laws of the State of Illinois shall apply to this transaction.  You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Cook County, Illinois, U.S.A. in all disputes arising out of or relating to the use of this Site and the purchase of any YG Commemorative ® Products or any matters set forth in these Terms and Conditions.
