1. INSPECTIONS
ALL ITEMS ARE SOLD “AS IS”. Local bidders are welcome to view our items in person prior to bidding at Garten Services by contacting us to schedule an appointment. Bidders can also visit our “About the Seller” (“me”) pages for more information about Garten.
2. OPTIONS FOR PAYMENT
Unless otherwise specified in the eBay auction listing, the winning bidder must pay in full within seven (7) days of the auction close date, using one of the following payment options:

· Cash payment in US currency (submitted in person only at the address below)

3. TAKING POSSESSION OF ITEMS WON
A buyer is in breach of contract if he/she pays for (an) item(s) won, but fails to arrange for removal of the property from Garten’s sale location within seven (7) calendar days of the auction close date. Should buyer fail to take possession of (an) item(s) won within that calendar day window, all right, title, interest and ownership to the property reverts to Garten Services, Inc., and the buyer forfeits any payment made on said item(s). THERE ARE NO EXCEPTIONS.
(a) STANDARD SHIPPING:
To provide exceptional shipping services, Garten Services, Inc. has changed shipping services from USPS Parcel Post to UPS Ground as of 10-19-09. UPS delivery time is 6 Business days and provides step by step tracking information. All standard shipping will be completed by UPS Ground except Priority Flat rate boxes. All new listings as of 10-19-09 reflect the shipping carrier change in the shipping calculator provided. Thank you.
· Buyer must pay in full within seven (7) days of the auction close date.
· Items to be shipped to buyer will be packaged and shipped by seller no later than three (3) business days after payment has cleared.
· Most Garten eBay items are shipped USPS Parcel Post; however, Priority Mail is used for items small enough to fit into standard sized Priority Mail boxes. Determination of shipping mode is based on dimensions and weight of each item.
· Included in each Garten Services eBay auction listing is a shipping calculator to assist bidders in determining shipping costs for each specific auction item. The shipping cost quoted will automatically indicate to bidder whether the item is scheduled to ship Parcel Post or Priority Mail and is all-inclusive, including packaging, handling and delivery costs.
· Handling charges for USPS Parcel Post items include: box cost, necessary packaging materials, processing and delivery confirmation. Parcel Post shipments may take 5-12 business days to arrive, depending upon the location of buyer. NOTE: In shipment of items with a winning bid value of $250 or more, eBay policy requires signature delivery confirmation and this cost will also be passed along to buyer.
· Handling charges for USPS Priority Mail items – used in those instances when smaller items fit into standard Priority Mail boxes – include: necessary packaging materials, processing and delivery confirmation costs (box is free). Optimal delivery time for Priority Mail is 2 days, although delivery can take up to 3 days in some instances. NOTE: In shipment of items with a winning bid value of $250 or more, eBay policy requires signature delivery confirmation; this cost will also be passed along to buyer.
· Online Delivery Confirmation Tracking at www.usps.com may take between 24-48 hours to appear on the web site, reflecting package location. Questions regarding online Delivery Confirmation Tracking should be directed to USPS.
· When a parcel shipped by USPS leaves our facility, seller should rest assured that every reasonable effort has been made to effectively protect the item(s) during shipping. Nevertheless, there are times when an item is inadvertently damaged by third-party handling while in transit. No legal recourse may be construed to seller.
· In very rare cases, a package may be lost in transit. Should this unlikely event this occur, please contact Garten immediately so we may initiate a package trace.
· Buyer may choose to arrange USPS shipment an item themselves (for instance, when they have their own USPS account). Garten Services is pleased to honor this option; buyer must be aware that all standard packaging and handling charges as described above still apply. A buyer who wishes to arrange shipping on their own account must issue a call tag for the item(s) to enable Garten staff to turn the item(s) over to your shipper.
(b) FREIGHT SHIPPING:

The item will not be shipped – or shipping may be delayed – if no bill of lading is provided or if pick-up is scheduled to occur outside of our business hours as stated above.
· When shipping via freight, all packaging and handling charges are waived by seller. Buyer is required to pay freightquote.com directly for all shipping costs.
· Freightquote.com offers freight insurance on all shipments for an additional fee at buyer’s discretion.
· After an item is shipped to buyer using freightquote.com and has left Garten’s physical plant, any damage discovered upon delivery is the sole responsibility of freightquote.com. Buyer must direct all post-receipt shipping questions or concerns directly to Crystal Foote or Lindsay Perkins of freightquote.com at 1.800.323.5441 x 1349 or 1234. No legal recourse may be construed to seller.
(c) LOCAL PICK-UP:
· The winning bidder must pay in full within seven (7) days of the auction close date. See Section 2(b) above outlining payment options for local pick-up.
· Items to be picked up by buyer must be picked up within seven (7) calendar days of the auction close date.
· All buyers planning local pick-up must email seller through eBay to arrange a date/time for pick-up in order to ensure readiness of the items and a fast transaction.

· Any buyer who opts for local pick up but fails to remove the property from Garten’s facility within the seven (7) calendar days of the auction close date – or schedules a pick-up and fails to appear on the designated day/time – automatically forfeits his/her right to the property. See Section 4(b) – Removal Default.
· Buyers are permitted to schedule property pick-up at Garten North Salem weekdays between 9am and 4pm, excluding holidays. In rare cases, prior written authorization may be secured from the Property Custodian for alternative pick-up arrangements.
NOTE: No property will be release from the Garten premises before 9am or after 4pm on weekdays (excluding holidays) without prior written approval from the Property Custodian.
· Should buyer elect to have a third party pick up their property, a letter of authorization must be furnished to the satisfaction of the Property Custodian, specifically identifying that third party, prior to release of said item(s) from Garten’s custody.
· When buyer removes property in person, all packaging or handling fees are waived by seller.
· Garten staff can assist in loading item(s) into a suitable vehicle provided by buyer within reasonable limits; however, Garten staff will in no case assist buyer in strapping or otherwise securing the item(s) in buyer’s vehicle. Buyer alone bears sole responsibility for safe transport of their auction property. It is essential that the buyer arrive at the Garten facility with all necessary, suitable and proper equipment required to safely secure and transport their property. Garten staff – at their sole discretion – can refuse to assist in the loading of any item if safety concerns exist, whether regarding the safety of Garten staff, buyer or the general public.
4. DEFAULT
(a) Auction Default: A winning bidder is in breach of contract if he/she fails to pay for the item won within seven (7) calendar days of the auction close date. Garten Services requires a reinstatement fee of $25 from each defaulting bidder and will block such bidders from participating in online auctions until such fee is paid.
(b) Removal Default: A buyer is in breach of contract if he/she pays for an item won, has opted to pick up the item at Garten rather than having it shipped, but fails to remove the property from Garten North Salem within seven (7) calendar days from the auction close date. All right, title, interest and ownership to the property reverts to Garten Services, Inc. and buyer forfeits any payment made on the item(s).
(c) Penalty for Repeated Defaults: If a bidder/buyer defaults more than once on either item payment or item removal, Garten may permanently revoke the bidder/buyer’s ability to participate in future Garten eBay auctions.
5. WARRANTIES, GUARANTEES & DESCRIPTIONS
(a) Warranties: None. Each and every item is sold “AS IS”.
(b) Guarantees & Descriptions: Garten Services, Inc. guarantees only the quality or working condition of items as described in the item’s eBay auction listing.
§ Property listed as “non-op” or “working condition unknown” should be considered inoperable and in need of major repair.
§ The absence of the terms “non-op” or “working condition unknown” in the item description is not intended to imply that an item functions or is in working condition and will in no way constitute the basis for a refund.
6. WITHDRAWAL OF PROPERTY
Garten Services, Inc. reserves the right to withdraw any property from auction should legitimate need arise. In such case, prospective bidders have no rights or recourse with Garten Services, Inc., its employees, agents or assigns.
