store (here-to-fore known as “the Seller” or “Seller”), I (here-to-fore known
as "the Buyer" or “Buyer”), understand and agree that the Buyer is
entering into a legal contract with the Seller and further agree to abide by
the details of following policies stated hereafter: ---SHIPPING
& HANDLING POLICY--- DOMESTIC
BUYERS: Shipping method of items sold on amacmedic’s eBay auction(s) or eBay
store are specified in the item description. The specific carrier determines
shipping charges. There is a standard domestic $4.00 handling charge on all
items sold on amacmedic’s eBay auction(s) or eBay store with the exception of
any item advertised with "Free Shipping" or where eBay handling
charge restrictions apply. Large items such as computers have an $8.00 handling
charge due to the extra protective packing that is utilized. Items normally
ship within 3 days, but in most cases will ship within 24 hours of seller
receiving payment. The Seller will notify the Buyer via email of any delay in
shipping. Seller will notify the Buyer via email within 24 hours of item being
shipped and supply any tracking numbers if applicable. The Seller, regardless
of item description, shall determine shipping method if item is advertised with
“Free Shipping”. INTERNATIONAL
BIDDERS: Shipping method of items sold on amacmedic’s eBay auction(s) or eBay
store will ship via USPS International Priority Mail unless otherwise specified
in the item description. No tracking offered from USPS except on registered or
express service. Items will ship within 3 days of seller receiving payment. The
seller will notify the buyer via email of any delay in shipping. Seller will
notify the buyer via email within 24 hours of item being shipped. In most cases
the item will ship within 24 hours with the buyer receiving either label
creation notification or shipping notification upon item being scanned for
shipping by the carrier. There is a $7.00 shipping charge on all items sold on
amacmedic’s eBay auction(s) or eBay store with the exception of any eBay
handling charge restrictions. Large items such as computers have an $11.00
handling charge due to the extra protective packing that is utilized and
customs documents. ---PAYMENT
POLICY--- As of January 15, 2009, eBay requires PayPal or other approved electronic method of payment for all items in this category. Other types of negotiable instruments are prohibited. Buyer has 7 days in which to pay for item won after the auction has ended. ---AUCTION WINNER NON-PAYMENT POLICY--- Refusal
by the Buyer to pay for any item purchased from amacmedic's eBay
auction or eBay store and/or not communicating to the Seller within 8
days of winning an
auction using either the "Buy-It-Now" option or auction by highest bid,
will constitute an automatic complaint to eBay from the Seller.
However, Seller agrees to attempt to communicate with the Buyer via
payment reminders or personal email payment reminders before filing any
"non-payment" complaint during the 7-day waiting period as required by
eBay. Buyer must make any reasonable effort to respond within 24 hours
of receiving any and all eBay payment reminders or personal email
payment reminders from the Seller with either payment in full for the
item purchased or an email of explanation for delay of payment with
payment following within a 24 hour period. Payment extensions may be
granted on a case-by-case basis. ---RETURN POLICY--- Receiving/Returning
Items Defective item(s), or items not as described, purchased through the Seller’s eBay auction(s) and/or eBay store are eligible for warranty return, if applicable, within 5 days of being received by the Buyer. To be eligible for return, the Buyer must inspect the item(s) upon receipt and notify the Seller of item(s) condition, whether defective or not as described, via email within 5 days of receiving an item(s). Item(s) are considered received (by the Buyer) when the Seller has received a delivery confirmation notice from the carrier by means of verifiable on-line tracking information, likewise, any returned item(s) are considered received (by the Seller) when the Buyer has received a delivery confirmation notice from the carrier by or by means of verifiable on-line tracking information. Auctions
that do not state a warranty anywhere in the item description are by default
eligible for either cash refund or replacement (see Buyer Responsibility). “CASH
REFUND” Warranty Item(s)
purchased through the Seller’s eBay auction(s) and/or eBay store, which have
been determined as “defective/not as described” (see Seller Responsibility),
with a cash refund option, and not sold in “as-is” condition may be eligible
for cash refund(s). Cash refund(s) are given via PayPal only. Any fees incurred
for refund transfer by use of PayPal shall be bore by the Buyer. “REPLACEMENT”
Warranty Item(s)
purchased through the Seller’s eBay auction(s) and/or eBay store, which have
been determined as “defective/not as described” (see Seller Responsibility),
with a replacement option, and not sold in “as-is” condition may be eligible
for replacement(s). Any and all costs or fees incurred for shipping of a
replacement item(s) to the Buyer shall be bore by the Seller. “AS-IS”
Warranty Item(s)
purchased through the Seller’s eBay auction(s) and/or eBay store with “as-is”
or “sold as-is” stated anywhere in the “Item Description” portion of the
auction site, have no implied warranty and therefore are not eligible for
return for repair/replacement(s) and/or cash refund(s). ---COMPATIBILITY
POLICY--- The
Buyer understands and agrees to being solely responsible for knowledge of
compatibility of items purchased through the Seller’s eBay auction(s) or eBay
store and therefore can not and will not hold the Seller responsible and/or
liable for refund or replacement of any item(s) purchased for reasons of
incompatibility. ---DISPUTE/COMMUNICATION
POLICY--- Buyer
and Seller understand and agree that the dispute/resolution communication
process as stated on this auction site is for a period of 14 days, which shall
begin after the time period allotted for inspection (see Seller Responsibility
Policies: Inspection of Returned Items). Buyer and Seller understand and agree
to communicate and sincerely attempt to settle any disputes between each other
within the 14 day period prior to resorting to any eBay/PayPal intervention
(see Buyer and Seller Responsibility Policies), i.e., use of resolution process
or chargeback process (where applicable). No excuse shall be deemed acceptable
for not attempting to settle a dispute or for circumventing the policies as
stated on this auction site prior to contacting the eBay/PayPal resolution
center. In
the event that a settlement cannot be reached between the Buyer and Seller as
stated in this policy, then and only then, shall the eBay/PayPal resolution
process be initiated. Any outcome of the eBay/PayPal resolution process may be
appealed. ---FEEDBACK
POLICY--- Feedback
will be left at the appropriate time for all transactions. Buyers will receive
feedback within 2 days of paying for an item. Sellers will receive feedback
within 2 days of my receiving the item that I purchased and paid for (provided
that the item is in "as described" condition). ---SHIPPING
DAMAGE & CLAIMS POLICY--- Item(s)
sold through the Seller’s eBay auction(s) and/or eBay store are guaranteed to
be "as described" at time of shipping and that item(s) are packaged
with appropriate shipping protocol, therefore, the Buyer understands and agrees
that the Seller can not and shall not be held responsible in any way for
damage(s) incurred to the items(s) during shipping. The buyer shall make all
claims for damage by a specific carrier to the carrier. ---VIOLATIONS
POLICY--- Buyer and Seller understand and agree that any attempt to circumvent/violate the policies and/or Buyer/Seller responsibilities as stated on this auction site, either in whole or in part, will render the eBay resolution process null and void for the offending party and in act the applicable Hold Harmless Clause. Any attempt by the offending party to use the eBay resolution process will be followed by appropriate action from the Buyer or Seller, which includes transmission of these policies, and any supporting evidence, to eBay/PayPal in part or in whole, to be used in the defense thereof. Seller
Responsibility Policies Inspection
of Returned Item(s) Upon
receipt of a returned item(s) (see “Receiving/Returning Items” of the Return
Policy), the Seller understands and agrees to be responsible to determine, or
cause to be determined, the condition of a returned item(s) within a 4-day
inspection period “Defective/Not
As Described” Finding Seller
shall notify the Buyer via email of “defective/not as described” returned
item(s) condition. The Seller may notify the Buyer (via email) of the returned
item condition at anytime during the inspection period, but must notify the
Buyer no later then 48 hours after the inspection period has ended of said
finding. Should the finding be “defective/not as described”, Seller shall
reimburse the Buyer for cost of return shipping to the Seller on items returned
for that reason. See also “Non-Defective” finding and "Communications/Dispute" policy of this section.
Email notification shall give the choice of “refund(s) or “replacement(s)” (if
applicable). Seller shall honor Buyer choice within 72 hours of receiving reply
email from Buyer. See also "Communication/Dispute" policy of this
section. “Non-Defective”
Finding Seller
shall notify the Buyer via email of “non-defective” returned item(s) condition.
Should the Seller receive a reply email from the Buyer (as outlined in the
Buyer Responsibility Policy paragraph Notification of “Non-Defective/As Described” Item(s)) requesting proof of
“non-defective” returned item(s) condition, the Seller shall provide the Buyer,
via email within a 72 hour time period, the cost of mailing of requested
documents. See also "Communications/Dispute" policy of this section.
Documents are to be sent USPS Certified Return Receipt. Seller shall then
place, in the mail, the requested proof documents within a 72-hour time period
after receiving payment (via PayPal) for cost of mailing. Communications/Dispute Seller
understands and agrees to communicate with the Buyer if a dispute arises. If
communication from the Buyer are non-existent or ceases during the 14-day
dispute resolution process as stated above in the “DISPUTE/COMMUNICATION
POLICY”, Seller shall send no less then 3 emails to attempt reestablishing
communication with the buyer within that 14-day period. Seller agrees in
sincerely attempting to come to a resolution of any dispute with the Buyer
before initiating the eBay/PayPal resolution process. If the Buyer does not
respond then the Seller may take appropriate action. See also
"Dispute/Communications Policy" stated earlier in this auction site. Hold
Harmless Clause In
the event that the above policies are violated by the Seller (where
applicable), the Seller agrees to release the Buyer from claims, demands, and
damages (actual and consequential) of every kind and nature arising out of, or
in any way connected with, the Sellers participation in the selling and/or
sales of items to the Buyer from amacmedic’s auctions and/or eBay store and
understands and agrees that the Buyer may initiate the eBay/PayPal resolution
process. Buyer
Responsibility Policies Inspection
of Received Item(s) Buyer,
upon receipt of an item(s) purchased through the Seller’s eBay auction(s)
and/or eBay store, shall inspect the item(s) to determine its condition. Buyer
must comply with the Return Policy: Receiving/Returning Items inspection as
early as possible to avoid loosing any applicable warranty as may stated on
this auction site. Notification
of “Defective/Not As Described” Item(s) Buyer,
upon discovering a defective/not as described item(s) (within the inspection
period), shall notify the Seller via email of the item(s) condition prior to
initiating any return of said item(s). After proper notification to the Seller,
Buyer must ship/mail any “defective/not as described” item(s) to the Seller
within 72 hours after the inspection period has ended (baring holidays and
weekends) for said item(s) to be eligible for applicable warranty. Buyer must
use carrier delivery confirmation option. If no such option is used, the Seller
is not and shall not be held responsible to honor any warranty as may stated in
the item(s) description. Buyer is initially responsible for return shipping
cost. Refund of return shipping cost (where applicable) will be reimbursed to
the Buyer only after the Seller has notified the Buyer of a “defective/not as
described” condition. Upon Buyer receiving notification, via email from the
Seller, of returned item “defective/not as described” condition and request to
the Buyer for “replacement” or “cash refund” (if applicable), the Buyer shall
notify the Seller via reply email, within a 72 hour time period with either
“replacement” or “refund” answer. See also "Communications/Dispute"
policy of this section. Any Cash Refund option is forfeited if the Buyer does
not reply within the time stated above in which case a replacement will be
given. Notification
of “Non-Defective/As Described”
Item(s) Buyer,
upon receiving notification via email of “non-defective/as described”
condition, may (within a 72-hour period) request from the Seller proof of
“non-defective/as described returned item(s) condition”. Buyer understands and
agrees that “proof” shall be sent via USPS Certified Mail Receipt. Cost of
mailing shall be bore by the Buyer, paid in advance via PayPal. Within 72 hours
of receiving and reviewing proof of non-defective condition, the Buyer shall
request from the Seller the cost of return shipping of “non-defective/as
described” item. Cost of shipping and handling shall be bore by the Buyer, paid
in advance via PayPal. Buyer shall send payment for S&H within 72 hours of
receiving cost information from the Seller. See also
"Communications/Dispute" policy of this section. Shipping carrier for
returned “non-defective” item to be determined at the sole discretion of the
Seller. Handling cost may not exceed $8.00 domestically, $11.00
internationally. Shipping cost may not exceed actual shipping quote as
determined by selected carrier. In
the event that no such request for proof is made within the given time frame,
or the Buyer notifies the Seller via email to waive such request for proof, the
Buyer understands and agrees to request via email return shipping cost and pay
said shipping cost as previously outlined in the paragraph above. See also
"Communications/Dispute" policy of this section. Non-Payment
of Return Shipping Cost Buyer
understands and agrees that refusal to pay the quoted return-shipping cost of
non-defective/as described item(s) as outlined in the “Notification of “Non-Defective/As Described” Item(s)”
paragraph above, the Seller shall refund to the buyer the cost of the item(s)
at time of purchase or auction end, minus an accessed $35.00 restocking fee. If
the restocking fee is more then the item(s) cost, then the Buyer forfeits any
and all refund. In addition, the returned item becomes property of the seller.
Buyer understands that Seller may initiate the eBay/PayPal resolution process. Communications/Dispute Buyer
understands and agrees to communicate with the Seller if a dispute arises.
Buyer agrees to sincerely attempt to come to a resolution of any dispute with
the Seller before initiating the eBay/PayPal resolution process. If
communication from the Seller is non-existent or ceases during the 14-day
dispute resolution process, Buyer shall send no less then 3 emails to attempt
